GIPA s.8 requires consideration when deciding access applications pursuant to s. 41.

Access Request

Please provide the policy document that sets out the NSW Police Force consideration that what and how it provides the consideration to s.8 access applications that fall under the provisions of informal release of government information.

Open Access

I also note that s.18 open access information may prevail here and I welcome NSW Police Force to proactively release this policy.

I note that GIPA Part 3 for Open access information under s.20(1)(b) provides

(1) An agency (other than a Minister) must have a guide (its
"agency information guide" ) that-- (b) describes the ways in which the functions (including, in particular, the decision-making functions) of the agency affect members of the public, and

Fees

Please provide consideration as to waive the application fee pursuant to s. 66 and s.51 of GIPA Act

GIPA s.66(2) provides that the fee is to be waived if the information was not in publicly available priori and given Right To Know autotomatically publishes the received informaton.

Alternatively provide a payment mechanism for 50% reduced fee pursuant to s.66 on which I reserve the right to appeal it.

Informal or Formal

If the waiver does not apply please also consider if you would be willing to release this information informally under the GIPA given this is a policy document relating to GIPA.

I reserve the right to appeal if this requires a formal application and where consideration should provide that GIPA handling policy should be released informally.

Advice and Assistance

I also believe NSW Police Force has obligation under GIPA assistance provision pursuant to s. 16 to help provide the policy regarding the consideration free of charge.

I reserve the right to appeal if this does not fall under the advice & assistance provisions and where consideration provides advice & assistance should be provided relating to agency GIPA policy.
