Fees / Charges

Please waive the application fee pursuant to s. 66 and s.51 of GIPA Act

GIPA s.66(2) provides that the fee is to be waived if the information was not in publcly available priori and given Right To Know autotomatically publishes the received informaton.

Alternatively provide a payment mechanism for 50% reduced fee pursuant to s.66

Reviewable Decision

I also note that UTS did not provide Part 5 reviewable decision reference in it's earlier repsponses despite this being required under the GIPA.

Additionally the decision whether to grant the access is separate from processing fee and the grant of access must be treated separate to processing fees.

Please determine the decision to either grant or deny or otherwise determine the access separately to the processing / application fees if any.

GIPA Act

A consideration must be given case-by-case basis to the fees and not institute a blanket determination of the deposit or a fee. UTS does not have the authority under the GIPA to institute a general fee without case-by-case consideration.

Informal or Formal

If the waiver does not apply please also consider if you would be willing to release this information informally under the GIPA given

Please provide the number of GIPA Applications made this financial year and how many of the applications were either denied or accepted.

If UTS has it available, I would like the aggregated categorised reasons for the rejections - either if it was categorised or not - mainly around rejection on basis of charges or fee otherwise but I understand UTS may not have retained this type of statistics.

Advice and Assistance

I believe UTS has obligation under GIPA assistance provision pursuant to s. 16 to help find statistical information whether it is available and in which form.

received by UTS on 29^th July 2024, sent via the Right to Know website.

 

You have requested access to the following information:

 

“Please provide the number of GIPA Applications made this financial year

Information on the number of applications, including the numbers that were
invalid or valid, and the decisions applied to decided applications, is
required to be reported annually under s.125 of the NSW Government
Information (Public Access) Act 2009 (the GIPA Act). The information
required to be reported is detailed under s.8 and schedule 2 of the NSW
Government Information (Public Access) Regulation 2018.

 

Our GIPA annual reports are included in our UTS Annual Report.

 

As a university, our financial year is based on the calendar year (January
to December), not the standard financial year (July to June). You can find
our 2023 financial year data in our 2023 UTS Annual Report (refer to pages

Given we will be required to publish the 2024 data, which will be included
in our 2024 annual report next year, we will release the current
information to you (see attached). The 2024 data attached does not include
applications that are currently being processed or your current set of
