Garage to Granny flat conversion - Drainage solution

We're waiting for Nj to read recent responses and update the status.

Dear Blacktown City Council,

I lives in Quakers hill. Apart from the main house, a car port and double garage are approved and build on the land. The land slops to the rear and does not have a drainage easement. All of rainwater is going to a rubble pit in the backyard.

I am looking to convert the garage to 1 room granny flat. is it allowed to install a charged line via rainwater tank to push granny flat rainwater to the street. When rainwater tank will overflow, it water will be pushed to street via gravity.

Hi Neeraj,

Thank you so much for your enquiry.

As per your information below email, Council does not support for dual occupancy or secondary dwelling on a land which slopping to the rear side unless there is a stormwater drainage easement pass through the property where drainage pipe can get connected. All stormwater shall be either reticulated to the street gutter or piped to a suitable location as approved by Council.

Where a site proposed for dual occupancy and secondary dwelling falls away from the fronting street, the DA must include documentation establishing a suitable drainage solution including inter-allotment drainage (and proposed easement) through downstream properties, and written permission from downstream property owners where applicable. Section 88K of the Conveyancing Act 1919 provides suitable mechanisms to negotiate the creation of easements where an amicable arrangement cannot be made. Council will not support the placement of fill on land to channel stormwater drainage back to the street.
