Dear Australian Prudential Regulation Authority,

The conduct of the corporate Trustee, NULIS Nominees (Australia) Ltd, has been the focus of attention at the Royal Commission into Misconduct into the Banking, Superannuation and Financial Services Industry.

NULIS is the trustee of a new superannuation fund established in 2016, the MLC Super Fund.

APRA would need to register this fund and pursuant to Section 29L of the SIS Act, NULIS would be required to lodge a copy of the Trust Deed with APRA.

The documents I seek are a copy of the Trust Deed of the MLC Super Fund lodged with APRA as well as a copy of the decision of APRA to register this fund in 2016

NULIS is the trustee of a new superannuation fund established in 2016, the MLC Super Fund.

APRA would need to register this fund and pursuant to Section 29L of the SIS Act, NULIS would be required to lodge a copy of the Trust Deed with APRA.

The documents I seek are a copy of the Trust Deed of the MLC Super Fund lodged with APRA as well as a copy of the decision of APRA to register this fund in 2016

I refer to your request for access to documents relating to the MLC Super Fund under the Freedom of Information Act 1982 (FOI Act).

As your request covers documents which contain information concerning the business, commercial or financial affairs of an organisation, or a person’s business or professional affairs APRA is required to consult with the person or organisation concerned (under section 27 of the FOI Act) before making a decision on the release of those documents.

For this reason the period for processing your request has been extended by 30 days in order to allow APRA time to consult with that person or organisation (section 15(6) of the FOI Act). The processing period for your request will now end on 12 October 2018.
