Good Afternoon,
Your Freedom of Information Request
I refer to your application dated 19 July 2016 in which you seek access to
documents under the Freedom of Information Act 1982 (the Act) as follows:
“Final itemised construction costs for the new Australian Federal Police
Forensics Facility in Canberra.”
Information considered irrelevant to the scope of your request
The AFP, in its management of FOI requests, excludes the following
information on the basis that is irrelevant to the scope of a request:
- Names of AFP members, other than the Senior Executive.
- Direct telephone numbers, signatures and mobile telephone numbers
of AFP members.
- Duplicate documents, including duplicate emails. The AFP will only
provide emails where they form a final email chain and the
authors/recipients are contained within the final email.
- Information that is publicly available, for example, newspaper
articles, online publications including information available on the AFP
Information Publication Scheme and the AFP disclosure log.
If you object to the AFP excluding any of the above information, please
advise this office within seven days of receipt of this letter.
Your request was received by this agency on 19 July 2016 and the 30 day
statutory period for processing your request commenced from that date.
You will be notified of any charges in accordance with the Freedom of
Information (Fees and Charges) Regulations, should they apply, in relation
to your request as soon as practicable.
Disclosure Log
Please be advised that in accordance with section 11C of the Act, an
agency is required to publish information on their website following the
notification of a decision in respect of a freedom of information
request.
The requirement to publish information released under FOI reinforces the
objectives of the FOI Act to promote a pro-disclosure culture across
government and to increase recognition that information held by government
is a national resource. Exceptions to the requirement to publish
information would apply to personal information and information concerning
the business affairs of a person if it was considered ‘unreasonable’ to do
so. Details of the decision may be published in a Disclosure Log which
can be found at
[1]http://www.afp.gov.au/about-the-afp/info...
Publication will be made in accordance with timeframes stipulated in
section 11C of the Act.
If, however, after noting the above, you wish to raise any concerns about
the publication of information concerning your request prior to the
notification of a decision, please advise this office in writing before 18
August 2016. If you do not raise any concerns prior to the date of the
decision, the AFP will publish the information as notified to you in the
decision.
Yours sincerely

Good Afternoon PMFarrant,
I am the case officer for your Freedom of Information request.
At this stage the construction costs for the AFP Forensics Facility have not been finalised. We can provide you costing up until 19 July 2016 (the date of your request).
Additionally, can you please clarify what you mean by 'construction' do you intend for this to purely mean the construction of the building or were you after the costs associated with the entire project?
To assist in the processing of your request I would be grateful if you could provide comment on the above two points. Happy to discuss further if required. I can be contacted via return email or on the phone number below.
Kind Regards,

Dear FOI,
It has now been nearly 4 months since I requested the Itemised Construction Costs for the new Australian Federal Police Forensics Facility in Canberra.
I had clarified and granted you an extension until September 17 2016. Now it is October 15, a month later and I have nothing from you.
I would like the promised information please.
At this time I would also request an internal review at a public authority. As you would be aware, this does not remove the obligation to process the request and provide the information requested.
Yours sincerely,
PMFarrant

Good afternoon PM Farrant
Extension of time request under s 15AC
On 18 October 2016 the Australian Federal Police (AFP) requested further
time to make a decision on your FOI request of 19 July 2016.
Section 15AC of the Freedom of Information Act 1982 (Cth) (the FOI Act)
allows the Information Commissioner to extend the processing time for an
FOI request where the initial decision period has ended and the agency or
Minister has not provided the applicant with notice of a decision. The AFP
has told the Office of the Australian Information Commissioner (OAIC) they
have not made a decision in the statutory time period. The FOI Act deems
that your request has been refused (deemed refusal).
As a delegate of the acting Information Commissioner, I am authorised to
make decisions on requests for extensions of time under s 15AC of the FOI
Act. I have decided to grant an extension of time of 10 days to
27 October 2016 to process your request. A copy of the decision is
attached.
This extension under s 15AC means that the deemed refusal is taken never
to have applied if the AFP makes a decision on your request by 27 October
2016.
Such an extension can only be granted once and cannot be extended by a
variation. An Information Commissioner extension under s 15AC of the FOI
Act does not enable the AFP to reimpose a charge.
