Dear National Disability Insurance Agency,

I am writing to make a request under the Freedom of Information Act for a complete copy of the departments' Freedom of Information (FOI) logs for the period 2013-2023, including any secondary departments controlled by the agency.

I request that this is provided as a document and not a simple redirect to the agency website as I am of the view that your online disclosure logs do not actively reflect your FOI requests that you have received in this period.

I would appreciate it if you could provide me with this information in an electronic format, such as a PDF or spreadsheet, if possible.

If there are any fees associated with fulfilling this request, please let me know in advance so that I can consider my options.

Thank you for your assistance in this matter.

Sincerely,

Watson Norwood

foi, National Disability Insurance Agency

Thank you for your email to the National Disability Insurance Agency
(NDIA) Freedom of Information (FOI) team.

If your email relates to an FOI application made under the
Commonwealth Freedom of Information Act 1982 (FOI Act), we will respond to
you as soon as practicable.

This email address is for applications under the FOI Act only. Our team is
unable to respond to non-FOI related enquiries sent to this email address.
Any correspondence received that is not related to an FOI request will not
be responded to or forwarded.

Please be aware: due to a high volume of requests, our ability to respond
to you in a timely manner has been affected. However, we will action your
request as soon as possible. In addition, we are currently experiencing
delays in processing FOI requests. As a result, whilst we will endeavour
to process your matter within the [1]legislative deadlines, we may need to
ask for an extension of time. We appreciate your understanding if this is
required.

The NDIA has a number of other ways to access the documents and
information that we hold. Please visit our [2]Access to
Information webpage to find out more about accessing information
through:

o The [3]myplace portal for participants
o The [4]myplace portal for providers
o The [5]Participant Information Access (PIA) scheme
o The [6]Information Publication Scheme (IPS)

You can also request data and statistics outside of the FOI Act. Please
visit our [7]Data and insights webpage page for further information.

Information about how to make an FOI request can be found on our
website: [8]Freedom of Information | NDIS. The FOI Act sets out the
criteria that must be met for a request to be considered. The request you
send us must:

o be in writing
o state that the request is an application for the purposes of the FOI
Act
o provide enough information to allow us to identify the documents you
are requesting
o provide an address for reply, either electronic or hard copy.

If you have questions about making an FOI request, or to enquire about a
current FOI request, please email us with your preferred contact method
and an FOI Decision Maker will contact you.

Should you have a query unrelated to FOI, please contact the Agency by
email at [9][email address] or via webchat at [10]NDIA Web Chat

Dear Watson Norwood

Freedom of Information Request: Acknowledgement

Thank you for your request of 7 May 2023 made under the Freedom of
Information Act 1982 (FOI Act), for copies of documents held by the
National Disability Insurance Agency (NDIA).

Scope of your request

I confirm you have requested access to:

o a complete copy of the departments' Freedom of Information (FOI) logs
for the period 2013-2023, including any secondary departments
controlled by the agency

Unless you advise otherwise, we will take it that you agree to the names
and contact details of NDIA staff being excluded from the scope of your
request (that is, the information will be treated as irrelevant).

Processing timeframes

A 30-day statutory period for processing your request commenced from 8 May
2023, in accordance with section 15(2A)(c) of the FOI Act. You should,
therefore, expect a decision from us by 6 June 2023.

This period may be extended if we need to consult with third parties or
for other reasons. We will advise you if this happens.

Disclosure Log

Information released under the FOI Act may be published on the NDIA’s
disclosure log located on our website, subject to certain exceptions.

Scope clarification

In order for your request to meet the requirements of the FOI Act, it must
provide enough information about the documents you are seeking to enable
us to locate them (see section 15(2)(b) of the FOI Act).

At this stage, I require further clarification from you as to what
information you are seeking access to as I am uncertain of what you mean
by ‘Freedom of Information logs’

It would be helpful to have a conversation with you regarding this and I
am happy to telephone you at a time that is convenient for you, to clarify
your scope.

In the meantime, to assist you in locating information already publicly
available, numbers of FOI applications managed by departments is captured
by the Office of the Australian Information Commissioner (OAIC) and
published on their website, see link below to OAIC annual reports. These
numbers will include all applications managed by an agency, not just those
applications that have been published on an agency’s disclosure log.

[1]OAIC annual reports | OAIC

As the requirement to publish information released to an FOI applicant on
a disclosure log does not apply to 3 kinds of information if publication
would be ‘unreasonable’, I have also provided the following link below
from the OAIC website to assist your understanding of disclosure logs.

[2]Part 14: Disclosure log | OAIC

Next steps

If you are happy for me to telephone you to discuss your request, please
respond to this email providing your telephone number and best time to
call you.

If you would prefer to respond by email only, please respond to this
email, clarifying the scope of your application, the type of information
required within the ‘log’ for example.   .

If I do not hear from you by COB 19 May 2023, I will proceed to process
your request with the information that you have provided, and I note this
may include not being able to release information to you.

Further help

Please contact us at [3][NDIA request email] if you have any questions or need
help.

We will contact you using the email address you provided. Please advise if
you would prefer us to use an alternative means of contact.

Kind regards
