Dear Ms Chopra
As advised in correspondence to you of 2 September 2015 the Freedom of
Information Act 1982 only applies to documents of the Court that are of an
administrative nature. The documents you sought in relation to your own
divorce proceedings were provided to you in light of rule 2.08 of the
Federal Circuit Court Rules 2001, which governs access to court records.
The rule provides that a party to proceedings in the Federal Circuit
Court is entitled to inspect and obtain copies of documents forming part
of the court record (emphasis added).
In respect of this further request as you are not a party to proceedings
please see the following information:
I am not a party to a divorce, but I would like to obtain proof of a
divorce?
If you are a third party wanting proof of a divorce you will need to
complete the [1]online interactive form.
Are there any fees?
Yes, there is a fee of $30 payable by Visa/Mastercard credit/debit card on
submission of the online form which includes a search of the courts'
records, proof of the divorce (if a record is found) and postage. This
fee is non-refundable. You will be notified by email if no record is
found.
How long will it take?
The processing time is approximately 10 working days. Please allow time
for postage.
How will I receive the proof of divorce?
If a record of divorce is found proof of the divorce will be posted to
you. We are unable to email proof of the divorce to you as it is an
original document.
If no record of divorce is found you will be notified by email.
