The request was successful.

Nigel Gladstone

Dear Local Council,

Can you please provide me with the number of food safety inspections carried out in your area annually, for the last three years?

How many warning were issued each year and how many fines each year?

What percentage of all food outlets did the council inspect each year?

Have any outlets been shut down for non-compliance and if so what for and how many?

What were the worst offences/biggest fines for each year?

Yours faithfully,

Nigel Gladstone

Dear Paulette Maroon,

I have received this information from another council without filling in any forms or paying any fees.

I have also made the request informally and at other councils they are processing it without the need for any forms.

Some councils ask for an Access to Information Request form to be filled out.

Why does your council require a GIPA form and $30?

Yours sincerely,

Nigel Gladstone

Paulette Maroon,

Dear Nigel

After consultation with our Environmental Health Unit in relation to your
request to access the information regarding food safety inspections for
years 2014 - 2016. As you may be aware, Cumberland Council is a newly
formed Council, which includes parts of the former Holroyd City Council,
Auburn City Council and Parramatta City Council’s. whilst I can advise
that Cumberland Council has an active food safety program, which is based
on a risk based approach with a balance of education and regulation, the
information you are seeking can be found in the Activity Report that
Council completes for the NSW Food Authority each year. The 2013/2014 and
2014/2015 reports are available on the NSW Food Authority website at
http://www.foodauthority.nsw.gov.au/rp/f, Unfortunately, the 2015/2016
results have not yet been made available online by the Food Authority.

Information concerning the offences and fines is available for viewing on
the Register of Penalty Notices on the NSW Food Authority website. The
register is sorted by suburb and can be found here
http://www.foodauthority.nsw.gov.au/pena

I trust the above information is of assistance.

Regards
Paulette

Dear Paulette Maroon,

This request is very simple as all the information I am asking for is contained in an annual report all councils provide to the NSW food Authority. The food authority send an email form each year and it is emailed back to them. Lane Cove council had it in their document management system but if you do not you can request it from the food authority and they will email it back to you.

The Food authority will not release the forms as it is third party information so I have to request it from all councils individually. I have already received this information from six councils without the need for a GIPA or any paper work as it is an informal request.

Yours sincerely,

Nigel Gladstone

Dear Nigel,

As mentioned in order for Council to process your request you will need to
complete a Formal Government Information (Public Access) Act 2009
Application Form along with a $30 application fee.

In order to gather all
the information requested accurately it will require some additional
resources so additional fees may apply. Furthermore as 2016 is still
current, and due to the Council Amalgamations Cumberland Council does not
hold any food and safety Inspections conducted prior to the Proclamation
on May 12, 2016.

Please find attached a formal GIPA Application for your perusal.

Dear Paulette Maroon,

I have already requested the information from Parramatta so you do not need to provide that information.

Specifically, I only require the Holroyd council data and I hope that is easier, there is no need to merge the numbers. I hope this simplifies the request and avoids the fee for public health information freely provided by more than 20 other councils already.

Yours sincerely,

Nigel Gladstone

Good Morning Nigel,

On this occasion I will waive the Fee for a Formal GIPA Application and
process your request informally, however you will need to complete the
attached Informal GIPA application for Council to release the information
you have requested, as this is Council's access to information policy.

Please find attached the Informal GIPA Application for your perusal.

Thank you for your cooperation.

Dear Paulette Maroon,

Thanks very much for your help. Can I confirm two things please: were there any Formal Improvement notices issued in any of the years and if so how many?

And why did every business get issued a warning? This is not the case for other councils, so I am wondering why it was different at Holroyd?

Yours sincerely,

Nigel Gladstone
