I am writing to request an internal review of Australian Taxation Office's handling of my FOI request 'FOI Health and Safety Incidents'.
Section 47E(c) will only apply where disclosure of the documents would prejudice management of personnel. Staff are under a duty under the Workplace Health and Safety Act to report health and safety incidents and ought to already be aware that public records are public under the Freedom of Information Act. The process does not rely on gratuitous cooperation by staff. In any case, an officer's decision to report and how to report will not be affected by knowledge that the mere existence of the report may be disclosed. They will only be affected if the full report is disclosed and only in those cases where the incident is very personal in nature, and again only on the assumption that the report would be released in full.
Names of officers should be withheld. A balance should be struck where the documents are released but information which would identify any injured person should be redacted.
At the very least the existence, number, timing and general nature or type of incident reports should be disclosed.
