Publicly available information
All agencies are required to report quarterly on their statistics,
including charges, to the Office of the Australian Information
Commissioner (OAIC). These reports are subsequently published, with the
latest available being the [1]2022-23 financial year. You can access this
data via data.gov.au. If you open the excel spreadsheet, at the very
bottom there are a number of different tabs. You will need to navigate
across to the tab ‘Charges’, and then you will locate the departments
statistics on row 134.
We seek your assistance in clarifying whether you are specifically seeking
the documents the subject of your request, or whether you are really after
the information. We note that the department does not issue charges
notices very often.
If you are seeking the information, we would be grateful if you could
review the publicly available information and tell us whether you would be
willing to amend your request to the time period that is not yet published
– 1 July 2023 to 1 October 2024.
General FOI matters
Timeframe for receiving our decision:
We received your request on 1 October 2024, and the 30-day statutory
period for processing your request commenced from the day after that date.
A decision is currently due to you by 31 October 2024. The period of 30
days may be extended in certain circumstances.
Charges:
Please note that the department may issue charges for processing FOI
requests. If applicable, we will advise you of any relevant charges when
we are in a position to estimate the resources required to process your
request.
Disclosure log:
Please note that, with some exceptions (such as personal information),

Exclusion of officials’ names and contact details:
It is the department’s policy to withhold the personal information of
junior staff from ministerial offices and government officials not in the
Senior Executive Service (SES) or equivalent, including their email
addresses and contact numbers, together with all signatures, mobile phone
numbers, departmental inboxes and technical transmission details including
reference numbers.
Duplicate documents and incomplete email chains:
Your request will be processed on the basis that you did not intend to
capture duplicate documents or duplicate emails within email chains.
If you require the excluded information or documents, please let us know

will take it that you agree to the information and documents being
excluded from the scope of your request.

with an extension of 7 calendar days to process your FOI request in
accordance with section 15AA of the FOI Act. This would mean that a
decision would then be due to you by Thursday 7 November 2024.
Background
The FOI Team have identified the documents in scope of your request and
have prepared a decision pack for the department’s decision maker.
The department is responding to the ongoing conflict in the Middle East
and are currently fully engaged on responding to developments in the
region.
The additional time will enable the department to finalise its processes
and provide you with an outcome.

We are writing to you to seek your agreement to providing the department
with an extension of 7 calendar days to process your FOI request in
accordance with section 15AA of the FOI Act. This would mean that a
decision would then be due to you by Thursday 7 November 2024.
Background
The FOI Team have identified the documents in scope of your request and
have prepared a decision pack for the department’s decision maker.
The department is responding to the ongoing conflict in the Middle East
and are currently fully engaged on responding to developments in the
region.
The additional time will enable the department to finalise its processes
and provide you with an outcome.

Thank you for your question regarding the interpretation of the scope of
your request.
Any information provided by the applicant of relevance to a charges
decision would be included in the decision letter.
The department’s decision and reasons for the decision are included in the
charges notices and decision letters. The emails effectively say ‘see
attached’.
This is why we sought your agreement to remove the emails from scope as we
considered that they would not contain the information that you are
seeking.
