We refer to our emails below which concerned your request in accordance
with the Freedom of Information Act 1982 (Cth) (FOI Act) (Request).

 

The right of access under the FOI Act is to existing documents. Generally,
the FOI Act does not require an agency to create a new document in
response to an FOI request.

 

No document contains a “list of company names of all wine producers in
Australia” per se.

 

However, a list of persons liable to pay the wine grapes levy or wine
export charge is labelled as a “list of producers” by section 29V of the
Wine Australia Act 2013 (Cth). The Department of Agriculture, Fisheries
and Forestry (Department) is responsible for administering Australia’s
agricultural levies legislation, including receiving levies, maintaining
the levy payer register (being the database of the details of individuals
and organisations who pay industry-specific levies and charges such as the
wine grapes levy and wine export charge). The Department is responsible
for preparing, and providing Wine Australia with, the list of producers
referred to by section 29V of the Wine Australia Act 2013 (Cth).

 

Given the above, Wine Australia interprets the Request as seeking access
to a document containing a list of persons liable to pay the wine grapes
levy or wine export charge.

 

On that basis, Wine Australia:

o considers that the subject‑matter of the Request is more closely
connected with the functions of the Department than with those of Wine
Australia; and
o considers that transferring the Request to the Department, in
accordance with section 16(1) of the FOI Act, is appropriate.

 

A transfer of a FOI request can facilitate access by avoiding the need for
an applicant to make a new request to another agency. Transfers of FOI
requests also allow decisions to be made by the agency best placed to make
an informed assessment about disclosure of relevant documents.

 

In terms of “next steps”, we suggest that either:

 1. Wine Australia, with the Department’s consent, transfers the Request
to the Department in accordance with section 16 of the FOI Act (in
which case the original “deadline” for a response to the Request would
continue to apply (noting the possibility of extensions of time)); or
 2. the Request to Wine Australia be withdrawn, and, should you wish to do
so, a new request be made to the Department (in which case the 30-day
statutory period for the Department processing that new request would
commence).

 

To enable us to take relevant next steps, could you please kindly advise
us as to how you would like to proceed by no later than 5.00pm (ACDT) on
Friday, 20 December 2024. In the absence of a response from you by that
time, Wine Australia will commence taking steps to transfer the Request to
the Department in the manner foreshadowed above.
