FOI Requests, Attorney-General

OFFICIAL

Good morning,

Thank you for your email received by the Attorney General's Department (the department). I understand from your request that you are seeking access to:

"any and all things, matters, records, documents , drafts, references including legal Instruments, subordinate legislation, imperial law, state or federal, Harsards pages where Corporation Act 2001 received Royal Assent which Constitutionally must abide Founding Documents Quorum 1/3 or 1/4 members present, have three readings and final vote Recorded in State or Federal Jurisdiction over the Parliament."

The department considers your request to be invalid. Section 15 of the Freedom of Information Act 1982 (Cth) (FOI Act) sets out the requirements for a valid request under the FOI Act.

Amongst other requirements, a valid FOI request must:
• State that the request is for the purpose of the FOI Act (s15(2)(aa)), and
• Provide such information as is reasonably necessary to enable a responsible officer of the agency or the minister to identify the document that is requested (s 15(2)(b)). This means that the department cannot process general requests for information.

As it stands, your request does not satisfy these requirements. Furthermore, the documents you have requested appear to be older than 20 years. This means that they are in the ‘open access period’ and cannot be accessed under the FOI Act. You can find further information here: https://www.oaic.gov.au/freedom-of-infor....

For your general information, I note that the Corporations Act 2001 received Royal Assent on 28 June 2001. This information is publicly available on the Federal Register of Legislation at: https://www.legislation.gov.au/Series/C2....

If you would like to re-submit your FOI request, please ensure that your request:
• states that the request is an application for the purposes of the FOI Act, and
• describes the documents you seek in enough detail to allow the decision-maker to identify and find them/

Further information about making a valid request is available on the Office of the Australian Information Commissioner (OAIC) website at: https://www.oaic.gov.au/freedom-of-infor....

The department will not take any further action in relation to your email.

Kind regards

Madeleine
