Dear Mr Morrison-Francis
I refer to the below request made under the FOI Act On 7 January 2022.
I am writing to advise you that your request has been transferred to the Commonwealth Superannuation Corporation (CSC) under s 16(1)(b) of the FOI Act. Section 16(1)(b) enables an agency to transfer a request if the subject matter of the request is more closely connected with the functions of another agency.
As the Treasury received your request on 7 January 2022, the 30 day statutory period for processing your request commenced on the day after that date. CSC will treat your request as though it received it the same day that the Treasury did. The period of 30 days may be extended if the CSC needs to consult third parties or for other reasons. They will advise you if this happens.
The CSC FOI email address is [email address].
Kind regards

Dear FOI,
I refer to the FOI act where it states you need to consult before transferring the matter.
CSC is currently refusing to deal with the matter and your office should hold records of exemptions issued by your office. It is absurd that you have asked CSC to respond when it is quite clear that your department would be the once’s issuing the exemptions in accordance with our request.
I suggest you review your decision ASAP or I will ask that OAIC intervenes.
If your office believes that no documents are held by your department then a “no documents exist” notice should be issued.
Yours sincerely,
Trent Morrison-Francis

Dear Mr Morrison-Francis
We write to acknowledge receipt of your request, under the Freedom of Information Act 1982 (FOI Act).
The Treasury received your request on 7 January 2022. The FOI Act provides that we have 14 days to acknowledge the request. The FOI Act provides that we have 30 days to process the request. This period may be extended if we need to consult third parties or for other reasons. We will advise you if this happens.
We will advise you if a charge is payable to process your request and the amount of any such charge as soon as possible.
We make the following assumptions that affect the scope of the request. These are set out below.
It is our usual practice:
• not to disclose the personal information of government employees or the personal contact details of senior government employees (including those of the Treasury). The names of senior officers will generally be released.
• not to release duplicates of any document captured within the scope of the request.
• only the final version of a document will be considered within scope.
Please inform us if you do not agree to the request being processed on the above assumptions. If we do not hear from you, your request will be processed on the basis that these documents are outside the scope of your request.
