As you confirmed in a discussion with Council staff on the 14th June 2022,
the reference document for your initial request is a letter from “Train
Reaction Pty Ltd” where ‘Environmental Review and Report’ is stated.
Further to that discussion, a generally agreeable outcome was reached in
that it would be beneficial to everyone to focus resources on moving
forward rather than re-investigating this aspect of the project.

We are delighted that the Whale Trail is now proceeding in a more cohesive manner and we have generally agreed to move forward.
Council staff advised on June 14 that staff have been unable to locate the report sought.
For clarification the report is referred to as follows in a letter addressed to me dated July 20 2021 from Train Reaction Pty Ltd under a heading “2.Material Considered”;
“2.1.7 Environmental Report and Review outlining the types of shrublands and grasslands in the Whale Trail site and explaining that Council does not support the proposed boardwalk because it will
result in significant loss of vegetation, habitat fragmentation and light intrusion.”
We have always referred to it as the Environmental Report and Review (“ERR”).
Please confirm that this Report cannot now be located.
In order to move forward we would like to have any similar reports or draft reports or relevant reports confirming your recent assurances to the NBRA and the Chamber that there are no material environmental issues in the pathways for the Whale Trail currently under discussion.
