Drug policies and testing
Dear Australian Sports Anti-Doping Authority,
I am requesting documentation under the Freedom of Information Act 1982, regarding the following:
- Documents outlining any and all illegal and legal drugs for recreation and/or performance enhancement in the NRL, AFL, A-League and Australian Institute of Sports programs
- Any discussions, documents, consultations or reviews between members of the ASADA program and all media and code representatives regarding the legalisation of any banned substances dated between December 31, 2013 and February 18, 2015.
- Any and all documentations outlining mandatory drug testing programs and requirements for all athletes in the NRL, AFL, A-League and Australian Institute of Sports programs

Dear Josh,
I refer to your email dated Friday 20 February 2015, in which you sought
access under the Freedom of Information Act 1982 (Cth) (‘FOI Act’) to:
“- Documents outlining any and all illegal and legal drugs for recreation

- Any discussions, documents, consultations or reviews between members of

A valid Freedom of Information Request (‘FOI Request’) was received on
Friday 20 February 2015. The processing period for your FOI Request will
commence from that date.
We will email you shortly advising whether charges will be imposed and
provide you with a preliminary assessment of the charges for processing
your request. If the estimated charges exceed $100, a deposit of 25% will
be sought. For estimated charges less than $100, a deposit of $20 will be
sought. You should note that work will not commence on your application
until the deposit has been paid.
When the matter is finalised a decision letter and final account will be
sent to you. This final account will be based on actual time spent on
search and retrieval, vetting and decision making in relation to your
request and is payable whether or not any documents are released.
Should we need to consult as part of responding to your FOI Request we
propose to disclose this request and your name to those parties.

I refer to our previous correspondence in relation to your Freedom of
Information Request (‘FOI Request’), which was lodged with ASADA on
Friday, 20 February 2015.
We have now considered the terms of your FOI Request in more detail and we
are unclear what it is that you are seeking. The request, in its present
form, could be interpreted as very broad in scope and, based on our
current understanding of your request, could also cover a significant
amount of material with is publically available (e.g. anti-doping policies
of major Australian sporting bodies such as the NRL, AFL and FFA).
Accordingly, we would like to consult with you to clarify the scope of
your request to ensure that we are clear as to what documents you
require. Once we have a better understanding of the documents you are
seeking under the Freedom of Information Act 1982 (Cth) (‘FOI Act’) we
will be in a position to process your FOI Request.
Further, in the context of refining what documents you are seeking under
the FOI Act, we would also like you to confirm whether you seek, as part
of your FOI Request:
1. documents that are already in the public domain or otherwise
publically available;
2. duplicates of documents;
3. chains of emails which are not the final email in the chain; or
4. draft documents (that is you only require final versions of
documents).
