A 30-day statutory period for processing your request commenced from 18
August 2024, in accordance with section 15(5)(b) of the FOI Act. You
should, therefore, expect a decision from us by 16 September 2024.
Extension of time under section 15AA of the FOI Act
We’re sorry it is taking us longer than expected to process your

time under section 15AA of the FOI Act. If you agree to this extension,
the new due date for us to make a decision on your request will be 16
October 2024.

Thank you for your request for information.
We are writing to provide an update on the progress of your request for
information.
We have consulted with relevant NDIA staff including staff who could be
expected to be able to identify documents within the scope of the request,
including staff who are knowledgeable about how to conduct searches of the
NDIA’s systems. Subsequently, we have received documents consisting of
over 220 pages. We are currently in the process of reviewing these
documents.
I note that under section 27 & 27A of the FOI Act, we are required to
consult with a third party regarding their views to the release of their
business and personal information in the documents. Therefore, we have
also conducted a third-party consultation seeking their views regarding
the release of their information in these documents.
The due date for a decision on access was 16 September 2024. However, I
note this time has lapsed and as a result we are deemed to have refused
your application under section 15AC of the FOI Act.
We sincerely apologise for this delay. We confirm we are continuing to
process your request for information and will ensure to provide you with a
decision on access as soon as practical.
