Deeds Lodged for Fund Registration - NSW Bookmakers' Super Fund
Dear Australian Prudential Regulation Authority,
The Superannuation Safety Amendment Act 2004 amended Superannuation Industry (Supervision) Act 1993 (SIS Act) to empower APRA to register superannuation funds.
Section 29L of the SIS Act required trustees to lodge a copy of the founding Trust Deed of the fund with APRA.
If the founding Trust Deed reserved an amending power then copies of all amending Deeds executed up until the time of fund registration also need to be lodged with APRA.
The NSW Bookmakers' Super Fund {ABN 22 973 371 189} was established in 1974.
The documents I seek are a copy of the founding Trust Deed of this fund and copies of all amending Deeds executed up until the time of fund registration (around 2006).
Section 29M of the SIS Act prevented APRA from registering a fund until copies of all the relevant Deeds had been lodged with APRA.
Yours faithfully,
Phillip Sweeney

Dear Mr Sweeney
APRA is currently processing your request under the Freedom of Information Act (FOI Act).
Given that the documents in question contain business information regarding the NSW Bookmakers’ Super Fund, APRA believes that the Trustee of that fund might reasonably oppose the release of these documents based on one of the exemptions in the FOI Act, and we have therefore consulted with them on this matter in accordance with section 27 of the FOI Act.
This email is to inform you that the consultation process automatically extends the processing period for your request by 30 days (to 5 February 2017).
Kind regards
APRA FOI Officer
Dear Mr Sweeney
