Extension of time application by the Australian Broadcasting Corporation
Dear Mr Harris,
I write to advise that on 24 January 2024 the Office of the Australian
Information Commissioner (the OAIC) received an application from the
Australian Broadcasting Corporation (ABC) for an extension of time, to
process your FOI request of 26 November 2023.
On 21 December 2023, the OAIC granted the ABC an extension of time to 24
January 2024 under s 15AB to process your FOI request of 26 November 2023,
based on the ABC’s extension of time application of 20 December 2023.
The ABC has applied for a second extension of time under s 15AB of the
Freedom of Information Act 1982 (Cth) because your request is considered
to be voluminous and/or complex.
The ABC has advised the OAIC that:
The Department has requested an extension to 9 February 2024. I will take
any comments you may have to make into account when deciding the
application.
Please respond to this email by close of business 30 January 2024. If I
do not hear from you by this date, the decision maker will make a decision
on the basis of the information provided to me by the AGD.
You will be notified of the decision once the matter has been finalised.
Further information about extension of time requests may be found on our
website at [2]Extensions of time.

Dear OAIC - FOI DR,
I agree to the extension to 9 February 2024, but would not agree to any further extensions as sufficient time has passed for the ABC to respond.
Yours sincerely,
Simon Harris

Good evening Mr Harris
The ABC has noted your response to the OAIC, of 1 February, granting the
ABC an extension of processing time until Friday 9 February.
We have not heard from the OAIC as to whether it has agreed with the
extension under s 15AB, however the ABC will work to issue the decision to
you by Friday.
We appreciate your patience, and understanding of our resourcing.
Many thanks,
ABC FOI team
