The following is a request under the Freedom of Information Act 1992 (the “FOI Act”).
I seek access to email correspondence between the Fair Work Ombudsman, Ms Natalie James and the Australian Public Service Commissioner, Mr John Lloyd (in his capacity as Public Service Commissioner or otherwise), between the period of 8 December 2014 to the date of this application.
For the avoidance of any doubt, my request refers to documents sent by Ms James to Mr Lloyd, as well as documents sent by Mr Lloyd to Ms James.
Documents falling within the scope of my request can be quickly identified and retrieved by searching all items (including archived items) in Ms James' email account profile according to persons sent to, and received from.

The Freedom of Information Act 1982 and the Freedom of Information

The information released in response to your request may later be
published online on the FWO’s disclosure log, subject to certain

Dear FWO,
Further to my request made of the FWO under s.15 of the FOI Act on 31 December 2017, I am willing to agree to the FWO redacting, from any relevant document, the personal information of any person mentioned in that document, except where that person was, at the relevant time: i) a public servant; or ii) a member of parliament. Noting paragraphs 6.153-6.154 of the FOI guidelines, this refinement of my request should negate any need for the FWO to consult with third parties under s.27A of the FOI Act.

I refer to you Freedom of Information Request (FOI) request which was lodged with the Fair Work Ombudsman (FWO) via email on Sunday 31 December 2017.

I confirm that even though we are well advanced in identifying and collating relevant documents, considerable work remains in reviewing the documents, conducting necessary consultation and assessing what information can be released to you in accordance with the FOI Act. For this reason we seek agreement from you to extend the proceeding period of your FOI request by 21 days, so the new decision due date would be 20 February 2018. We seek this extension in accordance with section 15AA of the Freedom of Information Act 1982, where the FWO and you can agree to extend the processing periods for the FOI request, but only by a further period of no more than 30 days.
Please confirm your agreement in writing to the above extensions by replying to this email. We will then give the Australian Information Commissioner (OAIC) written notice of the extensions as soon as practicable, as required under section 15AA of the FOI Act. We will continue working to process your request as efficiently as possible and are committed to providing you with notice of the FWO’s decisions in relation to your request by the revised date as noted above.
If you are not agreeable to the requested extension it will be our intention to seek a 30 days extension with OAIC under section 15AB of the FOI Act, related to complex or voluminous requests.

You've requested additional time to process my request partly for the purpose of "conducting necessary consultation". To assist my consideration of your request for an extension of time, could you please explain, with whom these consultations need to take place, and what provision of the FOI Act necessitates they take place.

Thank you for your email.
To clarify it is our intention to consult with relevant stakeholders within the Fair Work Ombudsman and conduct inter-agency consultation with the Australian Public Service Commission. Although the decision maker is required to make their own decision in relation to a request for access under the FOI Act, it is however good practice before making a decision to release a document to consult with other relevant agencies.
Through consultation the decision maker may discover that another agency has provided similar documents in response to an FOI request or it is already publicly available and consultation is particularly important in the case of complex requests.
Could you please confirm your agreement in writing to the above extensions by replying to this email by cob 23 January 2018.
We will then give the Australian Information Commissioner (OAIC) written notice of the extensions as soon as practicable, as required under section 15AA of the FOI Act. If you are not agreeable to the requested extension it will be our intention to seek a 30 days extension with OAIC under section 15AB of the FOI Act, related to complex or voluminous requests.

Extension of time under s 15AB
On 24 January 2018, the Fair Work Ombudsman (the FWO) applied for further
time to make a decision on your FOI request of 31 December 2017.
This application was on the basis that the processing period is
insufficient to deal adequately with your request, because it is complex.
Decision
I have decided to grant the FWO an extension of time to process your
request to 1 March 2018. This decision has been made under s 15AB(2) of
the Freedom of Information Act 1982 (Cth).
By granting further time it is anticipated that the FWO will provide a
well-reasoned and better managed decision.
