Correspondence Related to “The Juice Media”
Dear Department of the Prime Minister and Cabinet,
Yesterday, the creators of “The Juice Media” posted part of what they claim is a letter from DP&C.
The quote they provided that they say is from DP&C says:
"It has been brought to our attention that The Juice Media has used an Australian Government logo, and a symbol similar to the logo on the website www.thejuicemedia.com. The Department of the Prime Minister and Cabinet has received complaints from members of the public raising concerns that the content on this website may be mistaken for Australian Government material ... It would be appreciated if you would ensure that The Juice Media productions do not use the Australian Government logo to avoid The Juice Media productions being mistaken for Australian Government material"
Can you please supply:
- A copy of any correspondence, file notes, or other documents which detail communication between “The Juice Media” and DP&C
- All internal documents or correspondence in relation to “The Juice Media”.
- A copy of any complaint that was made directly or referred to DP&C in relation to items produce by “The Juice Media”

Thank you for your email dated 9 September 2017, received by the
Department of the Prime Minister and Cabinet (the Department), in which
you made a request to the Department under the Freedom of Information Act
1982 (the FOI Act) in the following terms:

Timeframe for receiving your decision
We received your request on 9 September 2017 and the 30 day statutory
period for processing your request commenced from the day after that date.
You should therefore expect a decision from us by 9 October 2017. The
period of 30 days may be extended in certain circumstances. We will advise
you if there is any extension of time.
Charges
Agencies may decide that an applicant is liable to pay a charge in respect
of a request for access to documents. If the Department decides that you
are liable to pay a charge, we will send you a preliminary assessment of
the charge as soon as possible.
Publication of documents
Please note that information released under the FOI Act may later be

Exclusion of officers’ names and contact details
For documents that fall within scope of the request, it is the
Department’s policy to withhold:
· any person’s signature;
· the names and contact details of Australian Public Service
officers not in the Senior Executive Service (SES);
· the mobile or direct numbers of SES officers;
· the names and contact details of Ministerial staff at a level
below Chief of Staff.
The names and other details of SES officers will not be withheld unless
there is some reason for that information to be exempt from release. If
you require signatures, the names and contact details of non-SES officers
or Ministerial staff below the level of Chief of Staff, or the mobile or
direct numbers of SES officers please let us know at [4][DPMC request email]
within 5 days so the decision-maker may consider your request. Otherwise
we will take it that you agree to that information being excluded from the
scope of your request (that is, the information will be treated as
irrelevant and redacted from any documents for release).

Good afternoon Mr Fairless,
I am writing in regards to your FOI request regarding The Juice Media.
The current due date for you to receive a decision is 9 October 2017.
The line area processing your request has advised that they have conducted
extensive searches for documents matching the scope of your request and
that these have taken longer than anticipated. Given this, we would
appreciate more time to assess the documents and make a decision.
Accordingly, I am seeking your consent to a 30 day extension of time to
the processing period, in accordance with section 15AA of the FOI Act. I
will endeavour to notify you of the decision prior to this extended date
but would appreciate more time to finalise the Department’s decision.
Should you agree, the new due date for a decision would be 8 November
2017.

Hi Ben,
I am writing in regards to your FOI request for documents regarding The
Juice Media.
We have finalised our searches for documents using the search phrase
“Juice Media” and we have retrieved approximately 450 documents.
Of these, about 400 appear to be media clippings. Such clippings are
circulated around the department daily so that all staff have an awareness
of what is in current media stories. This includes articles or stories
published by The Juice Media.
Given this, would you be willing to narrow the scope of your request to
documents regarding The Juice Media, specifically related to the use of
the Australian Government logo?

Good morning Ben,
I refer to your FOI request related to The Juice Media.
The statutory deadline for you to receive a response is 24 October 2017.
The Decision Maker has advised that your request covers documents which
contain information of a personal nature of a number of third parties. As
such, the Decision Maker has determined that there is a requirement to
consult the third parties under section 27A of the FOI Act before making a
decision on the release of the documents.
Subsection 15(6) of the FOI Act provides for an extension of 30 days to
the statutory time limit for processing requests. Therefore the deadline
for providing you with a decision on your request is now 23 November 2017.
