This is an access application pursuant to Government Information (Public Access) Act ("GIPA") made using special public benefit platform Right To Know ("RTK")

Fees / Charges

Please waive the application fee pursuant to s. 66 and s.51 of GIPA Act

GIPA s.66(2) provides that the fee is to be waived if the information was not in publcly available priori and given Right To Know autotomatically publishes the received informaton.

Alternatively provide a payment mechanism for 50% reduced fee pursuant to s.66

GIPA Act

A consideration must be given case-by-case basis to the fees and not institute a blanket determination of the deposit or a fee. An agency should not institute a general fee without case-by-case consideration.

Informal or Formal

If the waiver does not apply please also consider if you would be willing to release this information informally under the GIPA given this information should be in existing benchmark statistics.

Please provide the copy of the interim report received from the state as part of the NSW state launching the public inquiry to the affairs of Liverpool City Council - as part of Section 430 of the Local Government Act 1993 in relation to Liverpool City Council.

Dear Miss Anonymous,

I refer to your access application made under the Government Information
(Public Access) Act 2009 (GIPA Act), which was received on 3 September
2024. You have requested

 

‘ a copy of the Interim Report on Maladministration at Liverpool City
Council’

 

I have considered your request to

 

 a. apply a waiver of the application fee under s51A & or
 b. accept the application as Informal.
 c. apply a 50% reduction under s66 due to public benefit.

 

 

In determining your request, I will not be applying a waiver of the
application fee required for a formal application. I also note that the
requested material will require consultation with a third party under 54
of the GIPA Act and will require the public interest test. The report you
are requesting access to has been removed from the authors website
following court proceedings, for this reason I will not be releasing it
informally.

Furthermore, a determination on s66 cannot be made until such time the
application is accepted as valid.

 

If you wish to proceed with your application the $30 application fee as
required by section 41(1)(c) of the GIPA Act. You can make payment of the
$30 fee by credit card over the phone by calling 1300 36 2170 . Please
quote reference 293917/2024.  Cheques or money orders should be made out
to Liverpool City Council.

 

Please provide the requested $30 application fee by 2 October 2024. If we
do not receive your response by then, we will close the file, and your
application will be discontinued.

 

Review rights

If you do not agree that your application is invalid, you may seek a
review of this decision. Your review rights are set out in the enclosed
information sheet.

You have three avenues of review: internal review by an officer of
Council, external review by the Information Commissioner or external
review by the Administrative and Equal Opportunity Division of the NSW
Civil and Administrative Tribunal (NCAT).

You should note that the time for seeking an internal review is 20 working
days, or 40 working days for external review, after the date of this
notice.
