Dear David Mesman,
The cost around retrieval and decision making is unreasonable. I would like it to be reviewed.
This is a administrative lookup that requires very little effort or diversion of resources.
It also does not compare reasonably to other FOI requests that have been carried out. It is also unreasonable to attempt to extract Money from a public that is trying to hold NBN to account.
I would also like to request that you personally are no longer involved in any of the FOI requests and that it is diverted to another qualified individual within the organisation. If this cannot be actioned a suitable explanation will be required as to why?
Dear Mr Nothdurft - I note your request for a review of my FOI processing charges estimate (nbn’s reference FOI1920/48). I will complete an FOI Charges Decision in due course. If my initial estimate matches the final charges determination, I will consider your email, below, as a request for an Internal Review of that decision. In the interim, could you please provide further particulars regarding your contentions – that would be of assistance. I would also request that you email those contentions directly to [email address]. If I have not received any further contentions by 23 December 2019, I will proceed to a Charges Decision by 3 January 2020. If you require more time to provide your contentions, please inform me before 2 January 2020.
For reference, the appointment of nbn’s FOI Officer, the choice of FOI decision-makers and the processing of FOI applications are matters for nbn’s management. As outlined previously, I am nbn’s FOI Officer and I will continue to manage nbn’s FOI requests, including this and other FOI matters. nbn has informed you on at least six occasions of your right to make a complaint to the Office of the Australian Information Commissioner (OAIC) if you consider any complaints to be valid. My understanding is that you have not made a complaint to the OAIC to date. For your reference, I have copied the OAIC’s enquiries email address. I would suggest that you direct your concerns to the OAIC.

As you are aware I have submitted information to OAIC on numerous occasions to track behaviour of NBN staff and FOI team and processing fees - these are attached to OAIC reference numbers. You and your team would have a record of this.
I don't see how this is related to this request, if you are uncomfortable in discussing fees and decision making processes on public record then please provide a valid reason. My request for another independent and original authorised decision maker is also not unreasonable or "personal" under FOI act.
Please also be aware that OAIC staff have responded publically to a different FOI request and have very little visibility into the workflow.
I'm unsure why NBN internal processes are required to get OAIC involved. Under the FOI act I'm entitied to question and challenge charges internally as a first step.

requested a review of the preliminary fee estimate. As flagged previously,
nbn will assign an Internal Reviewer in due course and provide you with an
Internal Review of this fee decision in due course.
For your reference, it is the nbn FOI Team’s practice to suggest to FOI
applicants that they may wish to correspond outside of a publicly
accessible forum when making submissions regarding FOI processing fees.
This is because applicants may not wish to publicise details regarding
their financial situation, and especially f they are seeking a reduction
in fees due to financial hardship. Applicants may also be reticent to
provide their personal details regarding the payment of an FOI processing
fee invoice, its timing, etc.

Dear David Mesman,
I appreciate your internal concern on processing fees and privacy, I have confidence that NBN staff professionalism will ensure that you can continue to collaborate on the public record without issues and with a fair level of consistency and ethics.
Considering all previous requests to waive processing fees have been declined on both counts of public interest and financial hardship and that I have made payments in good faith a lot of NBN FOI activities seem to be "Money for Jam" .
I will continue to deal directly with NBN internal processes in this public collaboration platform until such time I feel that OAIC need to be formally involved.
Will wait for the internal review.
