I refer to your correspondence received by the Fair Work Commission
(Commission) on 15 July 2022 in which you seek access to documents under
the Freedom of Information Act 1982 (FOI Act).
In your email you request access to:
‘Documents, emails, file notes and other communications and records
relating to all complaints made about former Fair Work Commissioner
Barbara Deegan, and details of the resulting investigations by the FWC and
any independent investigations into Ms Deegan's conduct during her entire
employment (of some 18 years) with the FWC.’
The 30 day statutory time period for processing this request commenced on
the day following the day on which your request was received (subsection
15(5) of the FOI Act). As the due date for a decision falls on a Sunday,
the due date is automatically extended until Monday 15 August 2022
(section 36(2) of the Acts Interpretation Act 1901 (Cth)). The due date
may be extended in accordance with the FOI Act. The Commission will notify
you if there is any extension.
The Commission will advise you if a charge is payable to process your
request and an estimate of any such charge as soon as practicable.
