Commissioner Briefs
Dear Office of the Australian Information Commissioner,
I wish to obtain access (for the purposes of the Freedom of Information Act 1982) to official information held by the Office of the Australian Information Commissioner. The official information sought may not available in discrete form, in the written documents of the agency, therefore I request the agency to produce a written document containing the information in discrete form by use of computer and other equipment to retrieve and collate the stored official information sought.
Please provide a listing of all "Commissioner Brief" documents provided to the Australian Information Commissioner since 1 July 2020 (giving date, number of pages, and purpose of brief), and provide copy of the first page of each "Commissioner Brief".
Sincerely
Julie

Dear Julie
I refer to your request for access to documents made under the Freedom of
Information Act 1982 (Cth) (the FOI Act) and received by the Office of the
Australian Information Commissioner (OAIC) on 2 November 2020.
In your email you seek access to the following:
“…official information held by the Office of the Australian Information
Commissioner. The official information sought may not available in
discrete form, in the written documents of the agency, therefore I request
the agency to produce a written document containing the information in
discrete form by use of computer and other equipment to retrieve and

Please provide a listing of all "Commissioner Brief" documents provided to
the Australian Information Commissioner since 1 July 2020 (giving date,
number of pages, and purpose of brief), and provide copy of the first page
of each "Commissioner Brief.”
The term “Commissioner Brief” is ordinarily used by the OAIC only to refer
to briefs given to the Commissioner for appearances at Senates Estimates.
The term is generally not used for briefs to the Commissioner or the OAIC
Executive on other topics. I would be grateful if you would confirm
whether you seek only “Commissioner Briefs” relating to Senate Estimates
(in line with the usual usage within the OAIC) or whether you intend the
scope of your request to include all written briefs to the Commissioner
since 1 July 2020 on all subjects.
Would you kindly advise as to the scope of your FOI request by 19 November
2020.
Kind Regards,

Yes, as the the scope specifically identified (in quotation marks) "Commissioner Briefs", as opposed to seeking briefs (the generic term), the scope only applied to documents that are titled (at least in part) "Commissioner Briefs".

Dear Julie
Freedom of Information request
I refer to your request for access to documents made under the Freedom of
Information Act 1982 (Cth) (the FOI Act) and received by the Office of the
Australian Information Commissioner (OAIC) on 7 December 2020.
Scope of your request
In your email you seek access to the following:
“…full copy of documents listed as numbers 2, 9, 17, 19, 20, 21, 26, 27,
28, 29, 30, 32, 33, 36, 37, 40, 46, 47, 49 & 50 in the Schedule of
Documents to FOIREQ20/00213.”
Timeframes for dealing with your request
Section 15 of the FOI Act requires this office to process your request no
later than 30 days after the day we receive it. However, section 15(6) of
the FOI Act allows us a further 30 days in situations where we need to
consult with third parties about certain information, such as business
documents or documents affecting their personal privacy. We will notify
you separately if we need to consult a third party.
As we received your request on 7 December 2020, we must process your
request by 6 January 2021.
Disclosure Log
Documents released under the FOI Act may be published online on our
disclosure log, unless they contain personal or business information that
would be unreasonable to publish.
Request for an extension of time
We are currently processing your request and I now write to you seeking
your agreement, under [1]s 15AA of the FOI Act, to extend the time to
process your request until 5 February 2020. I note that even with the
extension of time request, I still intend to process your request as soon
as I am able to.
For the purposes of clarity and transparency, this extension of time is
sought due to the number of documents to be considered as part of your FOI
request and that staff will be taking leave during the end of year holiday
period.
If you would like to discuss this matter, please contact me on my contact
details set out below.
Yours sincerely

Dear Office of the Australian Information Commissioner,
Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of Office of the Australian Information Commissioner's handling of my FOI request 'Commissioner Briefs'.
The breadth of exemptions, given the scope of the documents they apply to (especially redactions of what are statutory reporting statistics), is excessive and needs review.
A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.righttoknow.org.au/request/c...
Sincerely
Julie
Dear Madam/Sir,
In relation to the Internal Review, it is relevant to note the documents in scope are briefs for the Information Commissioner's appearance before Senate Estimates and as such (and are often provided in a possible question and answer format) are created with the intention and knowledge that their contents may be disclosed in a public recorded forum (unless explicitly flagged otherwise).
As such, the original delegate has erred with respect to most of his exemption claims, given the primary purpose of these documents. It is apparent that only one or two of the redactions actually falls into material that was not intended for potential disclosure during estimates.
Sincerely
Julie
Thank you for your email.
I am currently out of office and will respond to your correspondence after

Dear Julie
Thank you for your correspondence of 14 January 2021.
I understand you are seeking internal review of the OAIC’s handling of
your FOI request regarding ‘Commissioner Briefs’.
However, as the OAIC has processed two related requests regarding
‘Commissioner Briefs’, could you please clarify whether you are seeking
internal review of the decision in FOIREQ20/00213 by Julie Brusentsev or
FOIREQ20/00232 by Mark Lindsey-Temple.
I would be grateful to receive your response by 1 February 2021.
Kind regards,
