Comcare improvement notice
Dear NDIS Quality and Safeguards Commission,
This request is an application for the purposes of the Freedom of Information Act.
Notices under the Freedom of Information Act may be sent to this email address. I don't want to be contacted by phone.
I want access to any emails which refer to, or discuss, the issuing of the improvement notice to the NDIS Quality and Safeguards Commission by Comcare in late April 2023. I am only interested in the above described emails where the emails were sent:
- to or by Senior Executive Service staff of the NDIS Quality and Safeguards Commission and
- between 26 April 2023 and 10 May 2023.
I do not need the improvement notice - the notice itself and any details about its contents can be excluded.
I do not need duplicate documents. Duplicates can be excluded.
I do not need the personal information of any NDIS Quality and Safeguards Commission staff below Senior Executive Service level. I also do not need the phone numbers of any Senior Executive Service staff. This information can be excluded.

Thank you for your email received by the NDIS Quality and Safeguards
Commission (the Commission) on 3 June 2023, in which you requested access
to documents under the Commonwealth Freedom of Information Act 1982 (the
FOI Act).
I have understood your request to be as follows:
Any emails which refer to, or discuss, the issuing of the improvement
notice to the NDIS Quality and Safeguards Commission by Comcare in late
April 2023. Including emails sent:
- to or by Senior Executive Service staff of the NDIS Quality and
Safeguards Commission and
- between 26 April 2023 and 10 May 2023.
I have understood your scope excludes the personal information of any NDIS
Quality and Safeguards Commission staff below Senior Executive Service.
Can you please advise if you approve the exclusion of personal information
of third parties (e.g. Comcare staff).
Please let me know if this interpretation is correct.
Timeline
The statutory period for processing your request is 30 days commencing
from the day after your request was received. Accordingly, a decision will
fall due by 3 July 2023.
The 30-day period may be extended under certain conditions, including if
third parties are required to be consulted, or where a request
consultation process is required. We will advise you if this happens.
We note that under administrative access arrangements you will not be able
to seek a review of the decision (only as it relates to those documents
released under admin release). We will advise you if administrative
release of some, or all, documents is appropriate once we start processing
the request and we’ll then seek your view accordingly. Further information
regarding the administrative release of documents is available on the OAIC
website [1]here.

Good afternoon Mr Faulkner,
This email is in relation to your current FOI request with the NDIS
Commission (FOI Request No 47).
Third Party Consultation Required
The purpose of this email is to inform you that the NDIS Commission has
conducted a search for documents that fall within the scope of your FOI
request and that search has located documents that contain information of
a business and/or personal nature of a third party. A third party is a
person or business that is not yourself as the applicant of the FOI
request to the NDIS Commission, or the Commission itself.
Sections 27 (business documents) and 27A (documents affecting personal
privacy) of the FOI Act require that I consider whether third parties
identified in documents might reasonably wish to make an exemption
contention because of business information in a document.
I have reviewed the documents that fall within the scope of your FOI
request and I have formed the view that certain third parties identified
in the documents might reasonably wish to make a submission on the release
of their business and/or personal information.
As such, the Commission must consult the third parties before an access
decision is made. Under section 15(6)(a), the Commission is granted an
additional 30 days to process the request. Your decision, as a result, is
now due on 2 August 2023.
Confidentiality
The NDIS Commission cannot disclose your identity to third parties
identified for consultation without your consent. Could you please advise
if you consent to the NDIS Commission providing your identity as the FOI
Applicant to third parties being consulted on your FOI request?

Please provide your response to the above question regarding your identity
by COB Friday 23 June 2023.
