Capacity building therapeutic activities & employment

Michelle O’Flynn made this Freedom of Information request to National Disability Insurance Agency

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was partially successful.

Michelle O’Flynn

Dear National Disability Insurance Agency,
I request information about music that include therapeutic drumming lessons is funded under the NDIS. As my daughters goals include long term goals of employment and particularly with a social connection, I wish to know how stated goals in this field (ie: long term training in radio production, sound engineering and DJing) and therapeutic drumming lessons will be approved?

Further to this, I request information about equine therapy. My daughter had ridden with RDA for 13 years from the age of 5. She then rode horses with privately paid lessons and also provided voluntary work at stables for a number of years following this.
As a stated goal of working with horses in both a voluntary or paid capacity, I’d like to know how furthering my daughter’s riding capabilities can be funded in this way.

Yours faithfully,

Michelle O’Flynn

Dear Michelle O’Flynn

Thank you for your correspondence of 14 April 2021, in which you requested
access under the Freedom of Information Act 1982 (FOI Act) to documents
held by the National Disability Insurance Agency (NDIA).

As you may be aware, all correspondence through the Right to Know website
is automatically published. This means that any information shared there
is public.

The NDIA takes the privacy of our participants very seriously, and we do
not discuss individual cases in any public forum. Discussions surrounding
plans or therapies as they apply to any participant would be best
discussed privately with a Local Area Coordinator (LAC) or planner.

Alternatively, you may wish to make an FOI request for participant
information through your own private contact details. If you do not
withdraw that part of your FOI request, it is likely that we will issue a
decision to refuse your request on grounds of privacy.

As regards those parts of your request that seek information more
generally about music, including therapeutic drumming, and how this may be
funded under the NDIS, and, similarly, information about equine therapy, I
am currently conducting searches and a formal decision in accordance with
the FOI Act will be issued at the earliest opportunity.

If you have any queries, please do not hesitate to contact me by email at
[1][NDIA request email]

Dear Michelle O’Flynn

Thank you for your request for information.

The Freedom of Information Act 1982 (FOI Act) provides a person a legally
enforceable right to obtain access to documents; however, the FOI Act does
not impose an obligation on a Commonwealth entity to provide documents
already in the public domain, or otherwise publicly accessible.

We have undertaken reasonable searches and identified that the documents
you are seeking are publicly available, namely:

·       Section 34 of the [1]NDIS Act in relation to reasonable and
necessary supports; and

·       [2]NDIS Operational Guidelines.

I note that funding decisions for all requested supports, including for
therapeutic music lessons and equine therapy, are made on a case by case
basis using the reasonable and necessary criteria outlined in the above
links.

As per my previous correspondence, all correspondence through the Right to
Know website is automatically published. This means that any information
shared there is public.

The NDIA takes the privacy of our participants very seriously, and we do
not discuss individual cases in any public forum. Discussions surrounding
plans or therapies as they apply to any participant would be best
discussed privately with a Local Area Coordinator (LAC) or planner.

Given the documents and information you are seeking are publicly
available, we are closing your request.

Please contact us at [3][NDIA request email] if you have any questions.

Kind regards
