Bus Services to Hobart Airport
Dear Tasmanian Department of State Growth,
Under the Freedom of Information Act, I am seeking any and all information related to MetroTas and services to Hobart Airport or just offering services to Hobart Airport.
In particular I am interested in why there are no services and if there was a response to Skybus offering services from Hobart Airport to Hobart city.
Yours faithfully,
John Flymore
Dear Mr Flymore
I refer to your request through the Right to Know website seeking
information relating to bus services to the Hobart airport.
You asked for your request to be treated as a request under the "Freedom
of Information Act". In Tasmania, the relevant legislation is the Right
to Information Act 2009 (Tas) (“the RTI Act”), and your request has been
considered in accordance with the provisions of the RTI Act.
Section 13 of the RTI Act provides that an application must contain the
minimum information as prescribed in the Right to Information Regulations
2021 (‘the Regulations’). The most important information that is currently
outstanding in your request, labelled according to the corresponding
letter of the Regulations, is as follows:
e) details of the information sought by the applicant under the
application, including all relevant dates and time periods that may relate
to the information being sought, if known by the applicant; and
f) details of efforts undertaken by the applicant, if any, before the
application was made, to obtain from publicly available sources the
information sought.
Section 16 of the RTI Act requires that all applications for assessed
disclosure (in other words, “formal” applications) must be accompanied by
an application fee of 25 fee units. Before an application can be
accepted, the fee must be paid or a decision to waive the fee must be
made. The fee may only be waived in specific circumstances, namely where
the applicant is:
· impecunious; or
· a Member of Parliament acting in connect with his or
her official duty; or
· a journalist acting in connection with their
professional duties; or
· able to show that he or she intends to use the
information for a purpose that is of general public interest or benefit.
There is no information with your request that enables a determination as
to whether you wish to seek a waiver of the fee or whether you are
eligible to do so, or that you have paid the fee. Under the RTI Act, your
application cannot be accepted as a formal application for assessed
disclosure.
More information about how the Department deals with its obligations under
the RTI Act is available on the
website: [1]https://www.stategrowth.tas.gov.au/about....
If you want to go ahead with a formal application, you may wish to use the
form published there. However, please note that assessed disclosure is
intended as the method of disclosure of last resort, so it may be more
productive in the first instance to simply contact the Passenger Transport
area of the Department directly with your information request:

Dear DoSG,
Thank you for your response.
I am seeking a fee waiver for this case, as I believe it is of public benefit and the outcome will shape public transport policy for all Tasmanian's.
Yours sincerely,
John Flymore
Dear Mr Flymore
Your request does not contain the minimum information to be compliant with the Right to Information Act 2009 (Tas), so is not accepted. In the first instance you must seek the information directly from the Passenger Transport area of the department at: [email address].
