Dear Australian Taxation Office,

My name is Timothy Von Dulm and I am the Head of Reference Services at the University of Pennsylvania, Biddle Law Library. I am contacting you on behalf of a law faculty member who has made the following request:

“I am looking for a briefing paper written by the Australian Tax Office to the Australian parliament concerning an international tax structure called the double irish dutch sandwich. It has apparently been publicly released.”

I notice that this briefing paper was referenced in an article by Katie Walsh entitled “Google Tax Scheme had ATO tick” on Jan. 22, 2013 (http://www.afr.com/p/national/google_tax...). In particular, the article mentions that the briefing paper was provided to the Australian Financial Review via a public records request.

This is to inquire if I might also be able to obtain a copy of this paper that was already released to the AFR. Unfortunately, I have not been able to locate this paper via other websites, so any assistance would be greatly appreciated.

Should you have any questions or require any additional information, please do not hesitate to contact me.

Thank you for your assistance with this matter,

Tim

It looks as if the document was probably the "hot issues brief" mentioned on the ATO disclosure log (http://www.ato.gov.au/About-ATO/About-us...). That document (FOI reference 59632) was released on 20 December 2012.

Timothy Von Dulm

Dear Australian Taxation Office,

Thank you for inidcating that the document I requested appears to be available on the disclosure log (59632). Unfortunately, the document does not appear to be available for download via the standard disclosure log acquisition process (it is not listed as available for download). Consequently, I would like to renew my request to receive this document.

Yours faithfully,

Timothy Von Dulm

FOI, Australian Taxation Office

Mr Von Dulm

I apologise for the delay in getting back to you.

The documents package for 59632 is now available from the ATO disclosure
