I note that you are requesting access to documents relating to Austroads. Austroads is a corporate entity and does not form part of the Department of Infrastructure, Transport, Regional Development, Communications and the Arts (the Department). The obligations of the Department under the FOI Act relate to a "document of an agency", which means "a document in the possession of the agency" (section 4 of the FOI Act refers). As such, any records held by Austroads would not be regarded as documents of this Department, and we would not be in a position to process your request for the records requested.

On this basis, could you please confirm that you are willing to withdraw your request from this Department.
