I refer to your correspondence received by the Department of Social
Services (the Department) on 27 March 2022, in which you made a request
under the Commonwealth Freedom of Information Act 1982 (FOI Act). Your
request was framed in the following terms:

 

Can you please provide the policy changed cited on page 134 of 'Portfolio
Additional Estimates Statements 2021-22 Social Services Portfolio', note
(c) that reads "As a result of change in Australian Government policy,
responsibility for the Information, Linkages and Capacity Building Program
was transferred from NDIA to DSS effective 31 January 2021".

 

Removal of non-SES staff names and contact details

The Department is seeking your agreement to the removal of the names and
contact details of non-Senior Executive Service (non-SES) staff, which may
be contained within any documents identified in relation to your request.

 

Based on the scope of your request, this information does not appear
relevant to you, therefore we would like to remove it under section 22 of
the FOI Act.

 

I would appreciate your response to this email by 12 April 2022 to advise
whether you agree that this information is not relevant to you.

 

Decision due

The statutory period for processing your request is 30 days commencing
from the day after your request was received. If the due date falls on a
Saturday, Sunday, or public holiday, in accordance with the FOI guidelines
issued by the Australian Information Commissioner, the timeframe will
expire on the first day following which is none of those days.

 

In accordance with paragraph (b) of subsection 15(5) of the FOI Act, a
decision on your request is currently due on Tuesday 26 April 2022.

 

When the processing period may be extended or suspended

 The current due date may be extended by up to 30 days if agreed by you
(section 15AA of the FOI Act). The due date may also be extended by an
additional 30 days in each instance, if your request is considered
voluminous or complex (section 15AB of the FOI Act) or if the Department
is required to undertake a third party consultation (sections 26A, 27 or
27A of the FOI Act). If any of these extensions apply, the Department will
notify you.  

Additionally, there are occasions where the time to process your request
may be suspended. This will usually take place if a practical refusal
consultation process takes place (section 24AB of the FOI Act) or if a
charges notice is issued to process your request (section 29 of the FOI
Act). If the Department decides that either of these apply to your
request, the Department will notify you.

The Department will correspond with you by email in relation to your FOI
request.

Update on status of request

We are engaged with the relevant line area regarding document searches,
and we are reviewing the responses we have received to date.

 

Currently, we understand that the scope of your request is seeking the
underlying policy (or policies) that led to the decision to transfer the
ILC program from the NDIA to DSS, as stated at item ‘c’ in the Portfolio
Additional Estimates Statements 2021-22 which you provided along with your
request. To this end, we would like to further engage with the line area
regarding those policy documents.

 

Request for extension of time

Due to the upcoming public holidays, the Department in effect has six (6)
days remaining in which to finalise your request. In addition, a number of
staff are taking leave between the Easter and Anzac day long weekends,
which is impacting our ability to engage with the relevant internal
stakeholders.

 

With apologies for any inconvenience caused, we would very much appreciate
your agreement to a two week (15 day) extension of time under section 15AA
of the FOI Act. This would make the new decision date Wednesday 11 May
2022.

 

I would be grateful for your response on or before Tuesday 19 April 2022.

Good afternoon Karen,

 

We refer to your email below.

 

In response to your request, we advise that the Department of Social
Services (the Department) does not hold documents that detail a specific
policy change regarding the transfer of the Information, Linkages and
Capacity Building program as cited at item ‘c’ on page 134 of the
Parliamentary Additional Estimates Statements 2021-22. The change was
considered to be administrative in nature as neither objectives nor scope
of the program were changed. The wording in the Portfolio Additional
Estimates Statements was meant in a general sense and was not a reference
to a specific policy document or any formal agreement to change the
existing policy.

 

As this is the case there are no documents that the Department is able to
provide in response to your request we are unable to reissue the documents
highlighting the policy changes as you have requested.

 

For your information, after some consideration, we have elected to deal
with your request as one for clarification about the documents issued to
you under the decision on 23 May 2022 as opposed to one for internal
review under Part IV of the Freedom of Information Act 1982. Our view is
premised on the specifics of your request and there being no need for the
Department to re-visit matters that are integral to the decision that was
made e.g. the adequacy of the document searches that were undertaken or
the reasons for exemption.

 

So that you are not disadvantaged by the approach that we have taken in
dealing with your request, if you would like to seek internal review of
this decision, we would be happy to accept that request any time in the
next 30 days (to 27 July 2022).

 

Usually an application for review is required to be submitted within 30
days of the original decision, but we recognise that you may have been
waiting for clarification of the original decision before making any
judgement about seeking re-consideration of the decision.

I am writing to request an internal review of Department of Social
Services's handling of my FOI request 'Australian Government Policy Change
in support of ILC transfer to DSS effective 31 January 2021'.

 

Can you please re-issue the documents highlighting the policy change that
triggered the  transfer of the Information, Linkages and Capacity (ILC)
grants program from the NDIA to DSS. I have read through the documents and
cannot locate the policy change cited in my original request.
