I note that you have also requested an internal review of this matter. The Department has previously received advice from the Office of the Australian Information Commissioner (OAIC) that once a decision has been deemed refused under section 15AC of the Freedom of Information Act 1982, section 54E prevents the Department from conducting an internal review.

As your FOI request became a deemed refusal on 3 December 2023, we are unable to process this as an internal review.

If you wish to seek a review of the decision for FOI 422/23/24, you will need to make a request with the OAIC.
