ATO Work from Home COVID
Dear Australian Taxation Office,
As reported in the media it appears the ATO considers Clause 50 of the ATO Enterprise Agreement does not apply to staff working from home as a result of the COVID-19 pandemic.
This is a request for the following documents under the FOI Act:
- Documents confirming the ATO decision that Clause 50 does not apply to staff working from home during the pandemic
- Documents created in reaching that decision
- Documents sent to employees communicating that decision
-Documents involving EL2/SES ATOP, ATO SES, or ATO Executive, created following union or employee concerns in relation to this matter

Dear Mr Wonka,
The ATO will close at 12.00 pm on Thursday 24 December 2020 and will re-open on Monday 4 January 2021.
We therefore seek your agreement to a 30 day extension of the processing period under section 15AA of the Freedom of Information Act 1982 to cover this shutdown period and other leave taken by staff around this time.
Of course, we will continue to process your request and provide our decision as soon as we can.
Could you please confirm your agreement to this extension at your earliest convenience but no later than 17 December 2020.
