Under section 16(1) of the FOI Act, where the subject-matter of the document is more closely connected with the functions of another agency than with those of the agency to which the request was made, the agency to which the request is made, may with the agreement of the other agency, transfer the request to the other agency. The department has therefore transferred your request to PM&C as the subject matter of the request is more closely connected with PM&C.

Accordingly, on 24 September 2024, the department transferred your request to PM&C.

On 4 December 2024, OAIC informed me that my request is now "deemed" to be refused. I asked two questions on 5 December 2024 and asked for a reply by 6 December 2024. The questions were:

A decision on your Freedom of Information (FOI) request was due by 24 October 2024. As the Department of the Prime Minister and Cabinet (the Agency) did not provide you with a decision by 24 October 2024, the Agency is considered to have made a deemed access refusal decision on 24 October 2024, in accordance with s 15AC of the FOI Act.

It is open to you to seek Information Commissioner review (IC review) of the Agency’s deemed access refusal decision of 24 October 2024. Any application for IC review would need to be made by within 60 days of the deemed decision of 24 October 2024 i.e. by 23 December 2024. As such you may be able to wait for a substantive reply. However, if you are not provided a substantive decision by 23 December 2024, any IC review application you make will be in relation to the deemed access refusal decision of 24 October 2024 and will be out of time

With regards to seeking a judicial review, this would only become available after the merits review avenues (IC review and ART review) have been exhausted.

Information Commissioner review application

Good afternoon Tyler,

On 17 December 2024, you applied for IC review about a Freedom of Information (FOI) decision made by the Respondent referenced at the top of this email. This was because you indicated you had not received a decision by the due date.

Why we are writing to you:

At this time, the Information Commissioner does not yet have sufficient evidence to be satisfied that you were the FOI applicant and, therefore, that you had the right to apply for IC review. This is because the Information Commissioner review application appears to have been submitted using a different email address, which was not used to make the request.

Section 54L(3) of the FOI Act provides that an IC review application may be made by, or on behalf of, the person who made the request to which the decision relates.

The Direction as to certain procedures to be followed by applicants in Information Commissioner reviews states:

Participation in IC review process:

The Direction further states:

Applicants must respond to requests for information from the OAIC within the time provided unless there are exceptional circumstances warranting a longer period to respond. If more time is needed, a request for an extension of time must be made to the OAIC at the earliest opportunity within the period provided for response, and no later than 2 days before that period is due to expire. Requests for more time must explain the exceptional circumstances that necessitate additional time and propose a new date for response. Approval of an extension request is at the discretion of the OAIC [2.22]

The OAIC expects that applicants and agencies will engage with the IC review process, with respect and courtesy [2.23]

As such, if you do not provide the information we need for the IC review application by 3 January 2025, we intend to close your IC review application.

Assistance

If you are unable to respond by 3 January 2025 you must request more time at the earliest opportunity. Requests for more time must explain why you need more time, and you must tell us when you will be able to provide a response.

Please note: You can withdraw an IC review application at any time. There is no penalty if you do this. You can also lodge a new FOI request to the respondent at any time.
