The department is unable to process your request because it is not a valid
application pursuant to section 13(b) of the Freedom of Information Act,
1991 (the FOI Act) which requires an application ‘must specify that it is
made under this Act’.

Additionally, the department is unable to process your request because it
is not a valid application pursuant to section 13(c) of the Freedom of
Information Act 1991 (the FOI Act) which requires an application to be
accompanied by the prescribed fee of $40.75. Please note an agency may
request further payments to cover the cost of finding, sorting, compiling
and copying documents. However, you will be notified in advance if any
further payment is required. The enclosed Freedom of Information (Fees and
Charges) Regulations 2018 detail the charges that may be incurred in the
processing of a Freedom of Information application.
However, if you believe that the fees or charges would cause financial
hardship and you are able to provide documentary evidence for us to
consider such as a copy of a current Commonwealth concession card or
documents to support your request for fee waiver (pay slips/bank
statements) you may request a waiver of fees.

At this stage we cannot accept your request for an internal review.
We received your FOI application on the 26 July 2024. On 30 July 2024 we advised you that your FOI application was invalid as it was not made under the FOI Act, accompanied by the prescribed fee or accompanied by documents to support a fee waiver. Subsequently a FOI application was received which became valid on 5 August 2024 and an acknowledgement stating your FOI application was being processed was sent to you on 5 August 2024. Therefore, the requirement for you to be provided with a response within 30 calendar days of receipt of your valid application has not lapsed.
