I am writing to request an internal review of Fairfield City Council's handling of my FOI request 'All documents relating to lunar new year celebration at Canley Heights Town Square from December 2015 to 29 February 2016'.
I first made the FOI request on 3 March 2016 and heard nothing from the Council for almost a month other than an auto email reply. After my follow-up phone call, I received an email attaching an acknowledgment letter dated 29 March 2016. Early April 2016 I called the council again and spoke to a different FOI officer who advised me that the FOI officer in charge of my request was on leave but promised that she would process the request ASAP.
I received nothing after two months. On 4 May I sent another email advising that Council's inaction would be deemed to have been a refusal and indicated that I would seek review of the decision in the competent tribunal with cost. On the same date, I received an email attaching SOME documents. I said "SOME" because I have in my possession documents and letters issued by the Council to Vietface TV which approved Vietface TV to conduct the event which have not included in the release. The Council's release of documents is incomplete and sketchy.
In my opinion there is nothing in the letters and other documents would be characterised as ground for withholding because of 'legal privilege or confidentiality'.
The council did not have a courtesy to advise me of those documents or any other documents that have been withheld due to legal privilege or confidentiality. This in itself demonstrates a degree and fact the Council has treated my request with contempt and unreasonably withheld information which is contrary to the legislative intent.
I would be grateful if my request to be reviewed urgently and in the manner which is different from the manner adopted by Council so far.
