Dear Blue Mangoes,
On 2 November 2022, you requested access to documents held by the
Department of Infrastructure, Transport, Regional Development,
Communications and the Arts (the Department) in accordance with the
Freedom of Information Act 1982 (the FOI Act).
We are writing to advise you that your request as it currently stands, has
grounds for practical refusal under section 24AA(1) as it is too large.
A practical refusal reason exists in relation to a request for a document
if the work involved in processing the request would substantially and
unreasonably divert the resources of the agency from its other operations.
We have conducted preliminary searches of our document management systems
and consulted with the relevant line area in order to identify the
documents falling within scope of your request. These searches have
revealed that the Agency is in possession of a large volume of relevant
material, specifically a high number of emails plus any attachments that
may be contained within those emails.
In accordance with section 24AB of the FOI Act, the Department is required
to consult with you advising of the intention to refuse access to your
request in its current form.
I am the nominated person with whom you should contact with a view to
agreeing to one of the following options:
a. withdraw your request;
b. revise your request; or
c. indicate that you do not wish to revise your request.
You may consider:
o Excluding all email correspondence from your request: and/or
o Specifying the exact documents that you are seeking access to.
You must contact us within 14 days to discuss or we will consider the
request to be withdrawn and it will not be dealt with any further.
While undertaking this consultation process, the statutory timeframes are
on hold, and will recommence if the reason for practical refusal has been
removed.
Should you have any questions relating to your request, please do not
hesitate to contact me via email to [1][email address]
Kind regards
Erin
