I am requesting all documentation associated to this report including:

- The actual Geotechnical Assessment reports from January 2024-January 2007
- The planned mitigation work that was completed in December 2023 including it's planning, scope of works, process and final assessment once the work was completed
- The cost of the work, design, persons/businesses and departments involved
- Who made the decision to start the work
- All electronic communication between the Geo-tech enigineers and National Parks & Wildlife Services from January 2022-January 2024
- The digital images, charts, graphs in regards to the movements of the rocks from January 2024-January 2007
- The original risk assessment chart and risk matrix evaluation from January 2023-January 2007

I have already made a formal request as previously stated in my first request which clearly outlines the exact information I am asking for. Which is not missing anything or details any different to the GIPA FORM...

As stated previously I want the information PUBLICLY sent here in electronic form due to the information being of special interest to the public.

There is literally multiple other examples of every other government agency or department responding to requests as well as, providing the information requested, the exact same way I have done and asked to provide it. You can search through the hundreds of agencies and departments listed on this website to have a look for yourself.

This is literally the entire point of this website and you're telling me I've been told to go to another website and do the exact same thing, which I'm under the assumption is just a ploy to delay this request or not post the information publicly.

Regardless, you have all the information you need from me, you know what information I'm asking for. If you need more time to provide the information then that's fine. I'll accept an 10 day extension if needed.

As stated previously you have received my request in clear writing in my very first point of contact.

Under the GIPA Act I can use own requests and NOT the forms available on the agency's website also, requests are considered as "valid" if they meet the following criteria:

In regards to the $30 payment, I'm requesting the fee should be waived (which I can do) as I stated in my previous response this information is of special interest to the public which is a valid reason and why I want it sent here so it can be publicly available at any time for anyone to view as well as, minimising the time the agency has to constantly spend resourcing this information for future requests.

4. My name is clearly visible the email address can be obtained if requested however, I don't see the point since I've stated previously I want the electronic PDF files sent here.

5. The exact information is all clearly stated in my very first request, which is located at the very top of all the messages as stated for the second time now.

I do not see how other Government agencies can oblige to these requests and can provide the information being requested through the exact same form I have but, NPWS choose not to.

If your response is going to be merely instructing me to go fill out the form provided on the environment government website, after 20 days starting from today's date:

I'm just going to write to the Information Privacy Commissioner that NPWS chose not to provide me with the information requesting with the agency's reason being:

Thanks for your email.

 

While you did make a request previously through the right to know website,
we treated that as an informal request for information. That is different
to a formal access application. The Department considers your request is
more appropriately dealt with as a formal access application. This is why
you were directed to our website to lodge one.

 

While you advise that the Environmental Protection Authority (EPA) had
acknowledged receipt of your request, they are separate government agency.
Correspondence from the EPA is not the same as correspondence from our
department, the NSW Department of Climate Change, Energy, the Environment
and Water (DCCEEW).

 

Under section 43(3) of the GIPA Act, An access application is not
considered to have been received by an agency until it is actually
received by the agency’. I confirm that your formal request for access to
information, made under the Government Information (Public Access) Act
2009 (GIPA Act), was received by DCCEEW yesterday, Monday 27 May 2024. It
has not been received prior to this date.

 

Your application is invalid

 

I am the Officer assigned to deal with your matter and I am deciding your
request is invalid. It does not meet the requirements set out in
[3]section 41(1) of the GIPA Act:

 

o You have not paid the $30 application fee. The special public discount
applies to processing charges (if imposed) and is not grounds to have
this application fee waived. For the avoidance of doubt, please
consider this email as notification that the $30 application fee will
not be waived. There is a lot of work that goes into processing and
deciding an access application, and the GIPA Act allows for a $30
application fee to be charged.

 

o Your application does not state the name of the applicant and the
email address for current correspondence in connection with the
application. It is my view that the name ‘Dre’ and the email address
of ‘[4][FOI #11402 email]’ is insufficient
to meet this requirement. It is unclear who you are and whether that
email address can accept attachments.

 

o Your email below does not include such information as is reasonably
necessary to enable the government information applied for to be
identified. While I appreciate you may have articulated this
previously, it did not accompany your request below. It needs to when
you are applying for information under the GIPA Act.

On 17 June 2024, the NSW Department of Climate Change, Energy, the
Environment and Water ('DCCEEW') received your request for internal review
of your formal GIPA access application received by DCCEEW on 27 May 2024. 
A fee of $40 is payable for an internal review (refer to section 85 of the
GIPA Act) however I have decided to waive the fee on this occasion.
If there are no suspensions or extensions of time for deciding this
review, we must complete the review within 15 working days of DCCEEW
receiving your internal review application, making the due date  8 July
