Dear Minister for Home Affairs,

Yours faithfully,

Dear Mr Mildenhall
Transfer of freedom of information request to another agency
I refer to your request for access to ‘correspondence in regard to Airsoft
and in particular the correspondence that was referred to in documents
from the office of the Attorney General from the 2010 briefing for the
firearms policy working group’, made under the Freedom of Information
Act 1982 (FOI Act).
I am writing to advise you that I have transferred your request to the
Attorney‑General’s Department. Under section 16(1) of the FOI Act, I am
able to transfer a request if the requested document is not in my
possession but in the possession of another agency or if the subject
matter of the document is more closely connected with the functions of
another agency.
The Office of the Minister for Justice does not hold the documents you
have sought access to, but the Attorney‑General’s Department may hold
relevant documents. Accordingly, on 27 September 2016 I transferred the
entirety of your request to the Attorney‑General’s Department.
We received your request on 23 September 2016 and the 30 day statutory
period for processing your request commenced from the day after that date.
The Attorney‑General’s Department will treat your request as though it
received it the same day that we did. You should therefore expect a
decision from the Attorney‑General’s Department by 23 October 2016. The
period of 30 days may be extended if the Attorney‑General’s Department
needs to consult third parties or for other reasons. They will advise you
if this happens.
If you have any questions about the progress of your request, please
contact [1][email address].
Yours sincerely,
Office of the Minister for Justice &
Minister Assisting the Prime Minister for Counter-Terrorism

Dear Mark Mildenhall,
Freedom of Information Request FOI16/147 – Acknowledgement of request
I refer to your request under the Freedom of Information Act 1982 (FOI
Act) for access to information relating to Airsoft. On 23 September 2016,
you requested the following:
“I would like to request copies all the correspondence in regard to
Airsoft and in particular the correspondence that was referred to in
documents from the office of the Attorney General from the 2010 briefing
for the firearms policy working group.”
We received your request on 23 September 2016 and the 30 day statutory
period for processing your request commenced from the day after that date.
You should therefore expect a decision from us by 23 October 2016. The
period of 30 days may be extended if we need to consult third parties or
for other reasons. We will advise you if this happens.
It is the usual practice of the department to not disclose the names and
contact details of junior officers of the department and other government
agencies, where that personal information is contained in documents within
the scope of a request. The names and contact details of senior officers
will generally be disclosed. We will take it that you agree to the
removal of junior officers’ personal information unless you advise that
you would like us to consider releasing that information as part of the
documents you have requested.
Please note that information released under the FOI Act may later be
published online on our disclosure log
[1]http://www.ag.gov.au/RightsAndProtection...,
subject to certain exceptions. (For example, personal information will not
be published where this would be unreasonable.)
Invitation to narrow scope of request
In its current form, your request is likely to result in a practical
refusal notice being issued. This is because the work we have done so far
indicates that continuing to process your request in its current form
would substantially and unreasonably divert the resources of this agency
from its other operations due to its broad scope.
It appears from your request that you are seeking access to the particular
correspondence referred to in documents from the office of the
Attorney‑General from the 2010 briefing for the firearms policy work
group. If you were to narrow the scope of your request to this
correspondence, the department would be in a position to process your
request on that basis. Accordingly, I would like to invite you to narrow
your request to the following:
“the correspondence that was referred to in documents from the office of
the Attorney‑General from the 2010 briefing for the firearms policy
working group.”
Please advise by COB Monday 10 October 2016 whether you agree to the
proposed revised scope to your request. If we do not receive
correspondence from you by this date we will proceed to process your
request based upon your original scope.
Kind regards,
FOI Legal Officer
