Thank you for your email of 27 February 2023 in which you made a request
under the Freedom of Information Act 1982 (the FOI Act) to the Department
of the Prime Minister and Cabinet (the Department).
We sincerely apologise for the Department’s delay in acknowledging your
request. Due to an administrative error your request was not registered
and actioned by the Department within the processing period. We continue
to recognise the original request date of 27 February 2023 for the
purposes of applicable FOI timeframes. While the processing period is
overdue, we will process your request as quickly as possible. If you no

Timeframe for receiving your decision
The 30 day statutory period for processing your request commenced from the
day after the Department received your request on 27 February 2023, your
request was due on 29 March 2023. The Department will process your request
as quickly as possible.

Please note that information released under the FOI Act may later be
published online on our disclosure log at

objections to the publication of any of the information which may be

Exclusion of officers’ names and contact details
For documents that fall within scope of the request, it is the
Department’s policy to withhold:
o any person’s signature;
o the names and contact details of Australian Public Service officers
not in the Senior Executive Service (SES);
o the mobile or direct numbers of SES officers;
o the names and contact details of Ministerial staff at a level below
Chief of Staff.
If you consider that the information categorised above is relevant to the

we will take it that you agree to that information being excluded from the
scope of your request (that is, the information will be treated as
irrelevant and deleted from any documents for release). The names and
other details of SES officers will not be withheld unless there is some

Apologies for the delay in processing your request. The Department has
undertaken searches across three separate IT and records repositories and
documents relevant to the terms of your request have been located. We are
working with the decision maker to finalise a decision on access and
anticipate a decision will be made within the next 8 days.
Section 15AC of the FOI Act allows an extension of the processing period
once the current processing period has expired, and with approval from the
Office of the Information Commissioner. Due to the misfiling of your
request and the extensive searches undertaken to locate documents, the
Department will request an extension of time to 4 July 2023 to finalise
your request. Where possible, the Department will finalise the request
prior to the extended due date.

Extension of time application by the Department of the Prime Minister and

I write to advise that on 27 July 2023 the Office of the Australian
Information Commissioner (the OAIC) received an application from the
Department of the Prime Minister and Cabinet (the Department) for an
extension of time, to process your FOI request of 27 February 2023.
The Department has applied for further time to deal with your request
under s 15AC of the Freedom of Information Act 1982 (Cth) because the FOI
Act deems that the Department has refused your request, as the initial
decision period for your request has ended and the Department has not
provided you with notice of a decision.
The Department has advised the OAIC that:
The Department has requested an extension to 4 July 2023. A decision
maker at the OAIC will take any comments you may have to make into account
when deciding the application.
