Is it possible to provide the following documents, within your office's possession, relating to Act No. 89 of 2009, Foreign States Immunities Amendment Act 2009?

I am looking for:

- Documents submitted to the Governor-General for royal assent to the Act (including the certificate from either the House of Representatives or the Senate, and the certificate signed by the Attorney-General recommending assent).

(I have enquired with the Office of the Parliamentary Counsel, and I understand that OPC does not have such documents in its possession.)

The purpose of this email is to acknowledge the receipt of your request and advise you that your request has been transferred to the Attorney-General's Department (the department) from the office.

Under section 16(1) of the FOI Act, an FOI entity can transfer a request if the requested document is not in the possession of that entity but is in the possession of another entity.

The documents being requested are provided to the department following the Attorney-General's consideration and signature and are no longer held by the office. Therefore the office has transferred your request, with agreement, as the department is more likely to hold them.

Your request is for:

Documents submitted to the Governor-General for royal assent to the Foreign States Immunities Amendment Act 2009 (including the certificate from either the House of Representatives or the Senate, and the certificate signed by the Attorney-General recommending assent).

Your request was received on 27 February 2025 and the 30 day statutory period for processing your request commenced from the day after that date. The transfer of your request does not affect the due date for completion of your request. The due date for your decision is currently Saturday 29 March 2025, and will be sent to you the next business date Monday 31 March 2025. The statutory period of 30 days may be extended if we need to consult third parties or for other reasons. We will advise you if this happens.

The department is seeking your agreement to exclude the following categories of information from the documents in your request:
- duplicates of documents that are in scope;
- personal information of members of the public;
- contact details for teams, internal to the department and other agencies
- personal information belonging to officers of the department and other government agencies.

Excluding the information listed above enables us to process your request more efficiently. If you agree to the above exclusions, the names of senior executive officers will be released where they are present in the documents and do not attract an FOI exemption. In addition, publicly available telephone numbers and email addresses will generally be released.
