Legislative requirements and publicly available information
Under Part XX of the Commonwealth Electoral Act 1918 (Electoral Act)
donors, candidates and political parties have obligations to provide the
Australian Electoral Commission (AEC) with returns. Further, section 320
of the Electoral Act stipulates requirements to publish determinations,
notices and returns. Section 320(2) of the Electoral Act specifically
states:
(2) A person is not entitled to inspect a determination, notice or return
referred to in subsection (1) before the determination, notice or return
is published under that subsection.
Information collected by the AEC is published online at
[1]https://periodicdisclosures.aec.gov.au/. Noting that Finance does not
manage this process, we would not hold any list as requested.
If you seek additional information regarding election donors or the AEC’s
process of collecting and/or reporting information, you may wish to
contact the AEC. Unless we hear further from you, Finance proposes to
treat this matter as finalised.
