National Disability Insurance Agency (NDIA).

 

Scope of your Request

 

You have requested access to:

 

“ A copy of all “Disability Snapshot” documents held by the NDIA.”

 

Processing Timeframes

 

In accordance with section 15(5)(b) of the FOI Act, a 30-day statutory
period for processing your request commenced from 18 September 2024. This
30-day period expires on 17 October 2024.

 

The 30-day period can be extended in a number of ways, including with your
agreement.

 

Unfortunately, it is currently taking us a little longer than 30 days to
process FOI requests. I am therefore seeking your agreement to a 30-day
extension of time under section 15AA of the FOI Act. If you agree to this
extension, the new due date for us to decide on your request will be 16
Noovember 2024

 

If you do not agree and we are unable to process your request within the
30-day period expiring on 17 October 2024, we will be deemed to have
refused your request and you will not have a right to seek internal review
of that decision. You will, however, retain your right to external review
by the Australian Information Commissioner.

 

Please let us know if you agree by 4 October 2024.

 

Disclosure Log

 

Subject to certain exceptions, documents released under the FOI Act will
be published on the NDIA’s disclosure log located on our website.

 

If you have any concerns about the publication of the documents you have

Dear Mykal,

I do not give my consent for an extension of time under the terms you have suggested. I would be happy to negotiate an extension of up to a 30 days if it involves a staged release of the documents, to allow you more time to process and complete the request, so that I'm not left with receiving nothing during the initial 30 day period.

I understand that refusing an extension will remove my ability to apply for an internal review, but as stated by the OAIC, the expiry of the timeframe gives the applicant the right to apply for IC review of a deemed decision – it does not remove the agency’s obligation to process the request and provide the requested documents to the applicant as soon as possible.

Regardless, you still have 15 days before the initial decision period expires on October 17th, and I hope you are able to use this processing time productively. If a staged release isn't practicable from your side, the agency is welcome to request an extension of time directly from the Information Commissioner.

Dear Mykal,

I am contacting you to follow up on my previous email (sent October 2nd), and ask again if a staged release of the documents would be possible if I were to agree to a 30 day extension. As it stands, the due date for this request is Thursday next week (October 17th).

I would really like to be able to come to an agreement so that I am not left waiting empty handed for 60 days, and the agency isn't left having to report any more unfavourable response timeframe stats to the OAIC. It can be a win for us both!
