Acknowledgement of Freedom of Information Access request
This letter acknowledges we received your request on Monday, 2 May 2022 to access documents held by the Department of Home Affairs (the Department) under the Freedom of Information Act 1982 (the FOI Act). This letter also provides important information about your request.
Scope of request
You have requested access to the following:
Number of Skilled Nominated (subclass 190) visa applications on hand by client location at lodgement (onshore & offshore) till date.
Your request was received by the Department on 2 May 2022 and has been allocated FOI request number: FA 22/05/00063.

Timeframe

The timeframe for processing a request is 30 days from the day we receive your request, as set out in the FOI Act.

Fees and Charges
Charges do not apply to requests from individuals seeking access to documents about themselves. However, a charge may apply to all other requests for access to documents.
Charges are based on the amount of time the Department spends on your request. Charges can range from $10 to over $1,000 depending on the complexity and scope of your request. The Office of the Australian Information Commissioner reported that across the public service, the average charge notified was $335.50 in 2020-21.
If a charge applies, you will be issued with a Notice of Charge that explains the charge and your options.

We do not provide personal details of staff

The Department’s practice is to exclude the personal details of staff not in the Senior Executive Service (SES), as well as the direct contact details of SES staff, contained in documents that fall within scope of an FOI request. If you require personal details of non-SES officers, or direct contact details of SES staff, please inform us so the decision maker may consider your request. Otherwise we will take it that you agree to that information being excluded from the scope of your request. However names of staff that have previously been released in departmental correspondence may be disclosed.
We do not provide duplicated documents

If the FOI decision-maker deems a document to be a duplicate, they will not assess those pages as part of your FOI request. This means that if a there is a decision to release the document to you, you will receive only one copy, even if multiple copies of that document exist.
Released documents you request may be published to our website

Where documents are released to you in response to your request, the Department may be required to publish these documents on its website within 10 working days in accordance with section 11C of the FOI Act. Publication will not be required where the documents contain personal or business affairs information.

Contesting Charges
As at 1 January 2022, the Department recommenced charging for FOI
requests. This is in line with the Freedom of Information Act and Freedom
of Information (Charges) Regulations 1982. For more information on fees

We note you are contesting the assessment of charges. The Department may
make a decision on whether a charge should be reduced or not imposed and
must take into account:
• whether payment of the charge, or part of it, would cause you financial
hardship
• whether giving access to the documents is in the general public interest
or in the interest of a substantial section of the public
 
This is not an exhaustive list and the Department may consider any other
relevant matters. Please set out your reasons and evidence in support of
your reasons as clearly as possible.

Dear Johny Sebastian

I refer to your email dated 2 May 2022 in which you request access to
documents held by the Department of Home Affairs (the Department) under
the Freedom of Information Act 1982 (the FOI Act).

You have requested access to:

Number of Skilled Nominated (subclass 190) visa applications on hand by
client location at lodgement (onshore & offshore) till date.

On 27 May 2022, the Department notified you of a requirement to pay a
processing charge of $12.50 in respect of your request.  In particular,
the Department notified you that, within 30 days of receipt of that
letter, you must either:

·         agree to pay the charge; or

·         contend that the charge has been wrongly assessed, should be
reduced, or should not be imposed; or

·         withdraw the request.

The Department notified you that if, within 30 days of receipt of that
letter, you failed to notify the Department of one of the above matters,
your request would be considered to have been withdrawn. The date provided
for final response was Monday, 27 June 2022.

On 2 June 2022, you requested a review of the charge, on the grounds that
previous requests had been issued without charge.

On 8 June 2022, the Department responded advising that the charge would
not be varied, and further advised that the Department had commenced
charging as of 1 January 2022 in line with the FOI Act and Freedom of
Information (Charges) Regulations 1982. The Department further provided
several options for waiving or reducing the charge and requested a
response by Tuesday 14 June 2022.

To date the Department does not appear to have heard from you. the
original 30 day period from the initial Notice of Charge issued to you,
has now expired. As such, in accordance with section 29 of the FOI Act,
Department considers that your request has been withdrawn.

Please be advised that your request has been deemed withdrawn for the
reasons provided in our email dated earlier on the same day, as you failed
to provide the required information for the waiver request by the due
date.
 
If you wish to lodge a new FOI request for the document, please do so and
provide detailed information to support your request for waiving the
charge.
 
Please note the Department’s previous request to provide evidence if you
seek to have the charge waived based on financial hardship.
This will enable the decision maker to make a well informed decision. The
specific evidence required was provided within the original Notice of
Charge document dated 27 May 2022 and was requested again in our reply
dated 8 June 2022.
