Your Freedom of Information Request
I refer to your request for access to documents under the
Freedom of Information Act 1982 (Cth) (
FOI
Act) related to the Vincent Namatjira portrait of Gina Rinehart.
I have taken your request to be for:
o documents related to the acquisition of these artworks, as well as any documents related
to objections of the artwork being displayed,
o any correspondence or documents related to the conditions upon which artwork may be
displayed in the gallery are also included in the scope of my request,
o any documents related to media requests on this topic in the last three months.
We received your request on
4 June 2024 and the 30-day statutory period for processing your request
commenced from the day after that date.
However, as your request covers documents which contain information concerning the business,
commercial, financial or professional affairs of one or more third parties, the National Gallery is required
to consult with those affected parties under section 27 of the FOI Act before making a decision on the
release of the requested documents. We will take into consideration any comments we receive from
these third parties regarding why they believe the documents should be exempt, but the final decision
about whether to grant you access to the documents you requested rests with the National Gallery. As
such, the period for processing your request has therefore been extended by 30 days in accordance with
section 15(6) of the FOI Act to allow the National Gallery time to consult. You should expect a decision
from us by COB
2 August 2024.
You will be notified of any charges in relation to your request as soon as possible before we process any
requested documents or impose a final charge.
