Dear Ms George,

I am somewhat surprised that the document requests I have made are grounds for practical refusal due to the large number of documents involved.

Of the three bullet points in my request:

"Any documents which identify the 'key milestones associated with the Class 5 medical certificate
exemption instrument' to be completed before timeframes for the Class 4 medical certificate can be
confirmed," should be located in the Class 4 project plan, able to be readily provided by the CASA project manager responsible for delivery of the medical reform program.

CASA made commitments in the General Aviation Workplan in relation to Class 4 timelines. Such a prominently published promise should be very well understood and clearly documented.

Similarly, "any documents which contain actual or proposed timeframes for the delivery of Class 4 medical certificate regulations," also ought to be part of the Class 4 project plan and able to be readily provided by the CASA project manager responsible for the delivery of the medical reform program.

My request for "any documents containing full or partial proposals for the content of regulations pertaining to the Class 4 medical certificate," could admittedly be open-ended if CASA has already performed significant evaluation and positioning.

So, with that said, I'd like to proceed with this by submitting a revised request.

I'd like this request to continue on the previously agreed timeframe, with its scope restricted to the first bullet point: "any documents which identify the 'key milestones associated with the Class 5 medical certificate exemption instrument' [referenced in the GA Workplan] to be completed before timeframes for the Class 4 medical certificate can be confirmed."

I'd like the other two bullet points in my request to be carried forward as two new requests, with a submission date of today's date, with delivery expected on or before COB 18 April 2024.

I trust this reduction in scope allows this request to continue without further interruption: It is inconceivable that CASA would have committed to producing timelines for Class 4 contingent on "key milestones associated with ... Class 5" without knowing what those key milestones are, and I'm anticipating that this request can be answered by the disclosure of one email message, slide deck or project plan deliverable specification.

Dear Mr Hibberd, Ms George.

I confess that I find this fascinating.

When I made my initial request for three line items, I was told that servicing it was onerous enough to form grounds for practical refusal, and I wouldn't be able to have any of it.

So I broke it up into two requests, where the first request covers the first line item and the second request covers the other two line items.

And your response to me asking for the same thing in a different form of words is that gathering the documents I've asked for isn't onerous at all, and I can have the requested disclosures as long as I'm prepared to give you money.

The only measurable effect of the notice of practical refusal has been to turn a 30 day FOI request into one that takes 60 days (and counting). I believe the initial notification of practical refusal was incompetently made for the purpose of producing delay. This, of course, colors my interpretation of the newly signalled intention to levy fees: Why should I expect that this new assessment has been conducted with any more expertise than the first, which was clearly objectively erroneous?

But of course, the only way I can find out is by paying the bill.

Please proceed with the $218.07 charge in your notification ref F24/10460, the $137.51 charge in your notification ref F24/10455, and the $421.67 charge in Amy George's notification ref F24/5860.

I acknowledge the frustration in the email below. You will appreciate that the application of the practical refusal rules depends on the scope of the request and that breaking your request into 3 means that each is a smaller request. While agencies have the discretion to determine whether requests are being broken up to avoid the practical refusal grounds in some circumstances, we have decided to process your new requests as separate applications. Following that determination, we continued our search for the documents that were objectively within the scope of your request and that resulted in the identification of the documents for which fees are now being levied.

The levying of fees remains a matter contemplated in the FOI Act and CASA's decision to levy fees follows the determination of whether the scope of your request is able to be processed, ie after a decision on any practical refusal reason. That is why no fees were levied on your original request.

We will issue a final charges notice shortly and proceed to make our decision on your requests once the payments have been received.

Further to my below email of 1 May 2024, where I issued you the formal
charges notice as well as the remittance advice, we have finalised our
decisions for each of your FOI request, F24/5860, F24/10455 and F24/10460.

In doing so, we identified that some documents which were included in the
original charges for F24/10455 and F24/10460 fall outside of the scope of
your request, and that some documents within both requests were duplicates
due to the nature of the scope.

 

For this reason, we have re-calculated the charges for both requests, with
the total charged amount for F24/10455 as $115.65 and the total charged
amount for F24/10460 as $176.35. Noting the overlap of documents, we have
decided to charge you for F24/10460 as $176.35, please find attached the
updated remittance advice.

Please also note we still require the payment for F24/5860, which was
noted in our previous email as a total of $421.67.

For ease of reference, please find attached the charges schedules for
F24/10455 and F24/10460, as well as the remittance advice for F24/5860 and
F24/10460.

 

Once you have returned the attached remittance advice with your details
filled in, our Accounts Receivable team will process the payment, which

Thank you for your patience.

I have an ongoing dialog with some of my Senators (and, indirectly, your Minister) about the legitimacy of requiring an FOI decision and $700 to release something CASA has already received a $200 budget appropriation to produce.

I expect that to conclude "soon." I'll be in touch next week about the remittance.

Dear Mr Newton,

On 26 April 2024, you agreed to pay charges in relation to all three of your FOI requests, F24/5860, F24/10455 and F24/10460.

On 1 May 2024, I issued you with a formal charges notice for F24/5860 and with the remittance advice to be completed.

On 2 May 2024, I recalculated charges for two of your requests F24/10455 and F24/10460 and also provided the remittance advice for both requests to be completed.

In my charges notices of 1 May 2024 and 2 May 2024, it noted that "if a payment is not finalised within 30 days of the date of this notice or such further period that CASA allows in writing, your request for access will have taken to have been withdrawn." In that time you flagged with me on 10 May 2024 (below), you were reaching out to Senators and the Minister in regards to the payment of the requests and you stated "I'll be in touch next week (by 17 May 2024) about the remittance."

I am reaching out to see if you have any updates regarding the remittance advice. I also advise that you have until COB Monday 1 July 2024 to confirm payment of all three FOI requests. If a payment is not made by 1 July 2024, all three of your requests will be taken as withdrawn. Once payment is made for the requests, all three decisions on your requests will be released to you.

Reviewing the material you've released:

Although some of it is newly published material (thank you!), there is also a significant quantity of it which consists of questionnaires, consultation feedback documents, manuals, and other materials which were already on CASA's website.

Is it CASA's usual practice to bill for FOI disclosures for pages which have already been disclosed?
