Hi Michelle
Thanks for your email.
I’m sorry about the continued delays with your FOI request.
I am writing to give you a progress update on your request and clarify
your review rights.
Progress update
I have conducted search consultations with multiple business areas in the
NDIA to locate the documents you are seeking. I was provided with
documents, however, when I reviewed them I identified that they made
reference to additional documents which we were not initially provided. As
such, I conducted a second round of search consultations to try to locate
these further documents that made be relevant to your request. I’m sorry
that this has caused further delays. However, my goals is to ensure I
conduct thorough searches to ensure I have captured everything that falls
into the scope of your request.
I am currently waiting for the business areas to respond with the second
round of documents. When they respond, I will review their responses. I
will keep you updated of my progress.
Review application
Thank you for your request for internal review of your FOI application.
However, I am sorry to advise you that as your request has not been
processed within the statutory timeframe, it is now considered a
‘[1]deemed access refusal.’ This means we are still processing your
request and are committed to providing you with our decision. However, it
also means that unfortunately you do not have internal review rights at
this stage. Therefore, we are sorry to advise that we can’t process your
request for internal review. If you would like to seek review of our
deemed access refusal decision, your next step is to seek external review
with the [2]Office of the Australian Information Commissioner (OAIC).
However, I would like to reassure you again that I have prioritised your
request and I am striving to give you a decision as soon as practicable.
If you have any questions, please reach out. If there are any further
delays, I will keep you updated.
Kind regards
