Dear Ms Bawden
Airservices Australia (Airservices) formally acknowledges the receipt of
your request for access to document under the Freedom of Information Act
1982 (Cth) (FOI Act). I sincerely apologise for the delay in responding.
I have given your FOI request the following reference FOI 23-44. I also
acknowledge that you have sought an ‘internal review’ of this request,
although as a first step I will need to process the original request.
You are requesting access to the following documents:
1) Aircraft ID number of the aircraft/s above the Adelaide CBD on 2/9/23
at 10.32am and 12.02pm.
2) Name of the person/ company which owns the aircraft.
3) A description of the purpose for the flight.
I note that my colleague wrote to you on 22 February 2024 seeking further
information regarding your request so we can confirm the scope. In
particular we would like to confirm the time mentioned in your request is
Australian Central Daylight Time or Coordinate Universal Time (which is
standard in the aviation industry). I ask because we are unable to find
any records showing flights over the CBD at the date and time (ACDT)
mentioned in your email.
Please can you confirm as soon as possible?
Regards,
FOI Coordinator

Hi Matilda
The agency is deemed to have refused your FOI request on 7 December 2023. Unfortunately, you do not have the right to seek an internal review of this deemed decision. The agency does not have power to conduct an internal review.
Your only review option is to apply for an Information Commissioner Review (IC Review). The FOI Act states that you must apply for an IC Review within 60 days of the access refusal decision. This means you have until Monday the 5th of February 2024 to lodge an IC Review application.
Alternatively, if you do not wish to pursue your FOI request further, you may instead choose to lodge a FOI Complaint to the OAIC.
Best of luck.
