I reply in response to my FOI request, your Ref: FOI 04-21 of 12 August 2021.
I note where you state, “The VRB prepares data which relates to your request in full financial years, not part. As such, the VRB does not hold data for the period 1 January to 30 June 2020…..”
May I draw your attention to DVA’s response to a Question on Notice No 283 of the 2019-20 Additional Estimates where the exact information I have requested, (by 6 months periods), was provided to the Senate, in this case for the period 1 July to 31 December 2019.
As this FOI request has not been fully responded to by 12 August 2021 I ask that you give this request your immediate attention.

Freedom of Information Request: FOI 45175
The Department of Veterans’ Affairs (Department) has received a transfer
of your FOI request from the Veterans’ Review Board (VRB), under section
16(1) of the Freedom of Information Act 1982 (Cth) (FOI Act).
Your request was received by the VRB on 13 August 2021, transferred to the
Department on 25 August 2021, and made in the following terms:
“…the number of appeals finalized by the VRB and the number that were
varied in full or in part for
the following periods:
· 1 January 2020 to 30 June 2020,
· 1 July 2020 to 31 December 2020, and
· 1 January 2021 to 30 June 2021.”
In accordance with section 15(5)(b) of the FOI Act, the due date for a
decision on your request is 13 September 2021.
When the processing period may be extended or suspended
The current due date may be extended by up to 30 days if agreed by you
(section 15AA of the FOI Act). Also, the due date may be extended by an
additional 30 days in each instance, if your request is considered
voluminous or complex (section 15AB of the FOI Act) or if the Department
is required to undertake a third party consultation (sections 26A, 27 or
27A of the FOI Act). If any of these extensions apply, the Department will
notify you.
Additionally, there are occasions where the time to process your request
may be suspended. This will usually take place if a practical refusal
consultation process takes place (section 24AB of the FOI Act) or if a
charges notice is issued to process your request (section 29 of the FOI
Act). If the Department decides that either of these apply to your
request, the Department will notify you.
We will write again when the Department has more information. Further

Request for extension of time to process your Freedom of Information
request
The Department of Veterans’ Affairs (Department) seeks your agreement
under section 15AA of the Freedom of Information Act 1982 (FOI Act) to
extend the timeframe for the processing of your request by 14 days. This
would extend the due date for your request to 27 September 2021.
We acknowledge that a response was expected from the Department by 13
September 2021, however due to the delayed transfer from the Veterans’
Review Board, the Department is still processing your request. We
apologise for this delay, and will make every effort to respond prior to
27 September 2021.
If you agree to this extension of time, the Department is required to
provide your name and contact details to the Office of the Australian
Information Commissioner (OAIC) for its records.
Please note that if you do not agree to this extension of time request, we
may have to apply to the OAIC for an extension of time under section 15AB

Dear INFORMATION.LAW,
Thank you for your response of 7 September 2021 requesting an extension to 27 September 2021. I require this information that will form part of my submission to the Royal Commission.
I note the DVA Secretary in FADT evidence post budget 2021 stated that an amount of $28.9M was allocated to DVA legal in order to expedite RC-FOI requests in connection with this Royal Commission.
As an act of good faith on my part I agree to an extension to 27 September 2021.
