Thank you for your correspondence of 29 April 2014, in which you requested an extension of time for the Department of Immigration and Border Protection (the DIBP) to process Deep Thought’s request, received 29 April 2014, under the Freedom of Information Act 1982 (Cth) (the FOI Act).
You advised that the DIBP already extended the decision period, by a further period of 30 days, to allow for consultation in accordance with s 15(6) of the FOI Act.
You have sought an extension on the basis that the current processing period is insufficient to deal adequately with Deep Thought’s request, because it is complex.
As a delegate of the Information Commissioner, I am authorised to make decisions on requests for extensions of time under s 15AB of the FOI Act.
We have decided to grant the DIBP’s extension of time under s 15AB (2) of the FOI Act to close of business 26 May 2014. In coming to this decision we have considered factors including your advice that:
· Consultations with Transfield Services/Wilson Security has been delayed due to Easter and ANZAC day holidays.
· Following receipt of consultation responses, these submissions must be reviewed and taken into account when preparing the FOI decision.
We are satisfied with the DIBP’s proposal to manage this request.
By granting an extension of time it is anticipated that the DIBP will provide a well-reasoned and better managed decision.
A copy of this decision will be provided to Deep Thought.
