I have written a formal response to the FOI request set out below (see attached letter).

 

Section 23 of the FOI Act says that the decision must be made by you (as the principle officer), unless you approve a different arrangement allowing someone else to act as the decision maker (such as me).

 

Unless I hear otherwise, I am going to proceed on the basis that you have, until further notice appointed me as the decision maker for these FOI requests.

Dear Mr Oshannassy,

I acknowledge your request for access to documents under the Freedom of Information Act 1982.

I have taken your request to be for all documents in the possession of the Australian Grape and Wine Authority (AGWA) relating to:

1.    the export of wine to destinations within the Asia/Pacific region over the past 24 months by Gemtree Vineyards Pty Ltd, or any other person where such wine is being sold under any of the following brands or labels:

a.    Gemtree;

b.    Sacredtree; or

c.    Gemstone; and

2.    the export of wine produced from the Gemtree Premises over the past 24 months.

I received your request on 18 July 2016 hence the 30 day statutory period for processing your request commenced from the day after that date. You should therefore expect a decision from us by 17 August 2016.

It is unlikely that any fees will be required; however I will not be in a position to confirm that until your request has been considered in greater detail.

I act for Sacredtree International Pty Ltd, who is a 50% shareholder of Gemtree Vineyards Pty Ltd (Gemtree).

 

Gemtree is a wine grower and producer and is based at 184 Main Road, McLaren Vale, South Australia (Gemtree Premises).

 

I request, and my request is an application pursuant to section 15 of the Freedom of Information Act 1982, that you provide to me access to all documents relating to the export of wine to destinations within the Asia/Pacific region over the past 24 months by Gemtree or any other person where such wine is being sold under any of the following brands or labels:

 

(a)   Gemtree;

(b)   Sacredtree; or

(c)   Gemstone.

 

I also request, and my request is an application pursuant to section 15 of the Freedom of Information Act 1982, that you provide to me access to all documents relating to the export of wine produced from the Gemtree Premises over the past 24 months.
